I think Bromley and Bexley have been using Gladstones for awhile and it's possible this letter is illegal. 

@mrmustard may know more.

Given the dates on the letter it does seem like an order for recovery was issued and is now out of time but the letter is as said out of process.

Please refrain from suggesting to simply pay PCNs - that is not advice and also therefore defeats the entire purpose of this forum. If everyone was to just pay their PCN as you suggest, this forum would not have a purpose.

It is not a case of" simply paying" PCNs.

The policy of this forum is to prevent people paying PCNs unnecessarily. So where there is some prospect of successful appeal, we strongly advise against paying, as paying closes the case.

However, there are two main categories where payment is advised to prevent the charge increasing, and a successful appeal would lead to refunds. These are:

1) Where a car is impounded, nonpayment of the PCN and release fees leads to non-release of the vehicle and incurring additional daily srorage fees.

2) Where bailiffs have become involved, as each subsequent visit/clamping /removal leads to greatly increased charges. Payment prevents increased fees and is refunded if the PCN is reset and successfully appealed.

I would be phoning TEC to check what application you need to make.
Making an OOT application when you might not need to can get messy.

Yes only received this one letter - Letter Before Claim as pictured.

I was out of the country for last month. I have just returned and immediately made an appointment to have my PE2 and PE3 signed.

Sent an email to Gladstones confirming receipt of their letter but that is it so far.

In regards to your link - I am surprised also, I did not think you could mix council related matters with private proceedings (CCJs etc).

But yes, no notice of enforcement has been received so far.

They've got themselves into a real pickle!

If Gladstones have been instructed by Bromley council that they, the council, have already obtained a court order, namely a warrant of control in respect of an unpaid penalty charge, then Galdstone's mandatory duty is to issue a Notice of Enforcement, not a Letter before Claim and certainly not 'legal proceedings'.

Re the suggestion to pay - I believe this is to avoid the penalty escalating rather than to throw in the towel. It would have no bearing on your application and the money would be refundable in the event the out of time application is accepted.  If it isn't, you then don't have to worry about bailiff costs increasing.

I've seen this location come up before.

There's no such road as High Street Bromley South.  The junction with Elmfield Road is with "High Street".

So, if you can get the PCN back in play, you can also fight it on the basis the contravention as stated did not occur.  The footage may also show no evidence of a contravention (but can't see that without the PCN number and vehicle registration).

Thanks for the response.

I moved address and sold the vehicle and did not receive any letters from the council.

The vehicle was driven by an ex-partner at the time and did not have authority to drive this vehicle.

Once submitted, the PE2/PE3 - this will then hopefully cause the PCN to revert to the initial stage, allowing me the opportunity to appeal said PCN. At that point I will provide evidence this vehicle was taken without consent.

OK so I see you moved. You could just pay it.

We usually see these after a bailiff has been instructed and it's best to avoid it escalating.

You can still make an out of time declaration but you'd need a good reason why you didn't get the PCN.

This looks like an odd letter - the date of the contravention is 5/10/24 and the sum demanded is £205 - this is the PCN at £130, charge certificate at £65, debt registration at TEC of £10.

I take it you've had no PCN, charge certificate or order for recovery? What is the status of the V5C logbook concerning the address at the time?

If a bailiff warrant is raised that adds £75, and a bailiff visit £235.

I guess you can file an out of time declaration if indeed it is out of time but for what reason. Is there a PCN status on Bromley's site.

Hello all,

I have received a letter from Gladstones. The letter is a Letter Before Claim for an outstanding PCN relating to a Yellow Box Junction Contravention PCN issued by Bromley Council.

This is the first time I have become aware of the PCN due to moving address and not actually owning the vehicle any more.

I am aware on how to deal with the TEC aspect - I have already booked an appointment with a law firm to have a PE2 & PE3 signed. However my understanding is that these forms would then be sent to the TEC not Gladstones.

How do I deal with the situation with Gladstones issuing the LBC - will this automatically be put on pause once submitted to TEC or do I need to form a seperate defence / reply to Gladstones?
