Another telltale sign is that this notice makes no attempt to invoke the requirements of PoFA 2012 to transfer liability to the keeper, unlike another Smart notice at https://www.ftla.uk/private-parking-tickets/smart-parking-ltd-ok-diner-derby-parking-fine-for-5-minute-visit/msg115302/#msg115302
The appeal should simply be on the basis that the registered keeper can not be liable, the driver will not be identified and Smart has not attempted to use PoFA 2012 to transfer liability, which would not be possible anyway.
If you can search for a simple appeal and if you want to post what you intend to send here first, we can double-check for you.
Smart will probably reject your appeal “after careful consideration” and that it was “correctly issued” but, if so, you can cost them £23 by using the IAS.

Good morning. I would very much appreciate your advice on whether you think this PCN can be successfully appealed. Having done some reading the NTK appears to have been issued too late in relation to POFA 2012 and the 14 day period
I've read the Read This First post and have put together the below:
Upon entering the car park, the driver found a space, parked up, and got into their friend's car. They then ordered takeaway to the friend's vehicle from a business at the location. When they left the car park they had exceeded the free parking period. On 7th May, I, the registered keeper, received a PCN through the post”
I am the registered keeper of the vehicle and have possession of the V5C
