The Protection of Freedoms Act 2012 (https://www.legislation.gov.uk/ukpga/2012/9/schedule/4) removed the ability of private companies to clamp cars and replaced it with requirements for them to follow to transfer the liability to the registered keeper. The companies themselves are still mainly ex-clampers with the same mentality. If you had nominated the foreign driver within 28 days you would have stopped being liable, but doing so later probably means that you will still be pursued, but given that it’s DCBL and DCB Legal you will just have to jump through hoops until they likely discontinue.

You say that the driver doesn`t live in the UK.
If that is the case then you could give their details to ECP as the driver.

Morrisons usually cancel tickets if asked, but if you’d told us it was Morrisons two months ago we could have advised this then.

If not, wait for a Letter of Claim, and research by searching the forum to see what DCB Legal usualy does, which is to make you jump through hoops but to discontinue the claim at the last moment, before they have to pay the court fee. If you keep us updated we can advise.

Apologies, I did mention it was a supermarket

The thing is, I’m actually happy to ignore if that’s what it takes as the “threatening” letters don’t really concern me.

My issue is the person that was driving doesn’t live in the UK, this is my local Morrisons and I go there all the time. Oh and any prospect of having my car clamped (which someone said won’t happen)

It’s now good to know that its a relatively “easy” fix, but as I wasn’t shopping I have no proof

Hi all it’s been a while as I hadn’t received anything. Yesterday I was able to get access to the flats at the end of my road where post often gets miss delivered where I found these:

Any advice please?

Time in car park was 2hrs and 49 mins

If anything is too identifying please lmk.

Euro Car Parks don't do Court so nothing to worry about.
To avoid getting the OP's hopes up, it's worth clarifying that ECP do 'do' court, insofar as they issue lots of claims. But they use DCB Legal, who, in the majority of cases, discontinue before a hearing.

Your car won't be clamped.

I’ve had a bit of a thought about this, what if I don’t actually receive the letter like before? what happens? Will they clamp my car?

(I’m going to go down to the flats to see if I can get in and if there are any letters left)

Can you advise on how I can obtain the original PCN? My address means that things often get delivered incorrectly.

Or will making contact make things “worse”

Based on it being highly unlikely, can you suggest what next steps would be?

We need the original PCN to offer proper advice.

As this is Euro Car Parks, it is highly unlikely that the NtK is PoFA compliant and therefore the keeper cannot be held liable.

Please post up the original PCN redacting only personal details - leaves all dates visible.

Hi all

Received the following PCN

Relevant to the overstay is Arsenal were playing at home so the car park was full and it took a while to find a spot.

This is the first letter I have got because my post is often miss delivered



The person driving said they’re not paying, and I don’t want to give their details over. Am I stuck with it?
