The appeal to the operator will fail 100% - it always does.

We can make a better appeal to POPLA.

thank you DWMB2. Will do. I know they will reject my "appeal" and they are only part of so called IPA (but they aren't truly independent) so is this just a waste of time appealing?

Leave out the bits about them providing gob evidence of signage and their contract with the landowner. They're not obliged to provide you with any evidence at this stage.

Would below be sufficient as an appeal?

I am appealing without admission as to the identity of the driver and expect this charge to be cancelled immediately.

The notice fails to comply with the requirements of Schedule 4 of the Protection of Freedoms Act 2012 because it does not specify the required period of parking and instead only provides a single timestamp. As such, you cannot transfer liability to the keeper.

Additionally, the allegation of “parked within a restricted area” is vague and unsupported by sufficient evidence. The signage at the location was inadequate to form a contractual agreement with the driver.

Please also provide evidence of your landowner authority to issue parking charges at this site, along with copies of the signage in place at the time of the alleged event.

In the absence of this information, the charge must be cancelled.

The NtK also fails to warn the keeper that the parking operator is required to meet the requitements of Schedule 4 in order to rely on PoFA.

You can appeal and put them to proof that it was posted so that it was served in time - making clear that you require proof of actual posting (which they are supposed to keep) rather than just bundling it to a 3rd party mailer.

It is also lacking a period of parking so not compliant with POFA to transfer liability to keeper.

Make sure not to ID the driver, especially inadvertently (by saying I did for example).

Received the attached parking charge.

They stated "Posting notice" date as of 25.02. However it landed in my mailbox only this morning? Is that royal mail being slow or they are playing with the dates?

Any feedback on how to appeal is highly appreciated.
