I have received the following email from Gladstone Solicitors -
Good Morning,
Thank you for your email dated 16th March 2026.
Please find attached the Evidence Pack which we trust to be self-explanatory.
Our Client is therefore satisfied the case against you should proceed unless the debt owing of £155.00 is discharged in full. To ensure no further action is taken, you should make payment on or before 8th May 2026.
If you do not make payment, we are instructed to issue legal proceedings to recover the outstanding balance in full. Should it become necessary to issue legal proceedings, we suggest you follow the steps on the claim form upon receipt of the same.

Request for Erasure of Personal Data
We refer to your request regarding a request for erasure of data.
Unfortunately, we cannot process your request because we can demonstrate legitimate grounds for the processing of your data, which override the interests, rights and freedoms of you as an individual.
That legitimate interest being that we are acting on behalf of our client Horizon Parking Limited for the recovery of monies relating to an unpaid Parking Charge(s), number(s) HP3705121.
To process your data is necessary and lawful, as it is required in furtherance of our clients instructions, and we act for them on their rights and obligations for the recovery of such monies.

We must also confirm that you also have the right to a judicial remedy (ie claim compensation through the courts), if you remain unsatisfied with the outcome of a complaint to the Supervisory Authority and you believe there has been a breach of the General Data Protection Regulations 2018. The ICO cannot award compensation and so if you cannot reach an agreement on the amount of compensation where appropriate, you can apply to court. Reply to the LBC with the following;
To whom it may concern,
I can confirm that I have received your Letter Before Claim.
I am the Registered Keeper of the vehicle in question.
I refute that any charge is owed by myself to your parking operator client.
I would respectfully suggest that you ask your client to check their payment logs since full payment was made to cover my visit to the car park in question.
It appears very obvious that this PCN was issued in error without the correct checks being made.
It is alarming that my details were requested in the first instance since all keeper data requests from the DVLA require manual checking - in this instance the parking operator appears to show a total disregard for the correct process.
I also note that my details were then passed to a third party debt collector (yourselves) thus exaggerating the data breach.
I am happy that I have now clearly set out my legal position on this matter and I await confirmation from your client that the PCN has been cancelled - in the meantime, please remove my wrongly acquired keeper details from your system.

But it's not an overstay in this instance.
The BIGGEST single piece of evidence in this matter is your 'confirmation of contract' which demonstrates 1 hours parking being bought at 15.49 and specifies that your session will expire at 16.49.
A confirmation of contract is EXTREMELY powerful evidence in ANY contract dispute.
They will have next to no chance in court if it ever gets that far.

The machine has 'Predictive' text and as you type Registration number selects for you (if that makes sense?)
Also, no slip is printed by the parking machine, it's all online/automated.
NTK issue reason is - Failure to pay for full duration of stay.
ANPR captures on the way in but most likely is not/ can't assess how busy the parking is.
It may well take 5 to 10 minutes on a busy day/weekend to find a bay, then due to having to exit in to a main road, there can be traffic build up leading out (as this exit ANPR pic shows a queue leaving).
Surely no Judge will entertain 11 seconds overstay as an ACTUAL overstay?

Agreed.
Your confirmation of contract shows that you purchased 1 hours parking at 15.49.
This would take you to 16.49 - You left at 16.45 - Hard to see their reasoning unless it is purely a 'time on site' argument.
Please double check that the correct Reg was entered?

The parking payment transaction time shows 15:49
ANPR shows exit at 16:45:31.751
(Not sure what the Decimal is about!)
