I haven't received the paperwork yet. They've only sent me a rejection email (found in my spam folder!) on the 20th of this month.
I'll try and call them and I'll definitely write up my appeal to the tribunals.

Sorry, I don't know either. Maybe ring them up and ask, because you've had the rejection of your reps, so next stage is register an appeal at London Tribunals. Have you done this yet because the clock is ticking ?

Oh I'm definitely taking them to the London tribunals for sure. ;)
I'll update with the outcome.

Thanks...

OK, you're cross, like I am, but are you prepared to take them to London Tribunals ? If you don't they'll just carry on collecting money from others in the same way, (and probably you again if you have to do more pick-ups like this).

Thank you so much for your reply..
Is there any information online about the legislation in regards to "attended" on a loading bay?
This is outrageous. I've successfully appealed the exact same type of pcn's in the past but this takes the biscuit...
Also Tfl doesn't except a tribunal to be done online...!!! It's all through the post.  It's 2026 for god sake.
£750 million is crazy per annum..
Thanks again.

Their letter is total tosh, (as usual). There is no legislative requirement whatsoever that demands that the vehicle be attended at all times during loading. How could it possibly be if the loading involved collecting goods from premises ? You were in the bay for less than the 20 minutes allowed.

Essentially they are doing what they always do, refuse the reps and re-offer the discount knowing most people then just cough-up. In my opinion, if you take them to London Tribunals you should win, but of course, must risk the full PCN penalty. Re-offering discounts is how London councils and TfL earn over £750 million per annum from PCNs. It's a "nice little earner" isn't it ?

TFL

Earls court road

46: Stopped where prohibited (on a red route or clearway)

Hi all, newbie here.

Please advise as I have been rejected by Tfl as I was picking up an order as I am a self employed courier.
I've successfully appealed THE EXACT SAME TYPE OF PCN JUST LAST MONTH ON THE SAME ROAD but this time tfl are being difficult.

I left my vehicle to collect an order from a pick up location very close to the loading bay. You can clearly see me with my food delivery bag in one of the pictures. I was well under the 20 mins allowed and only left my vehicle for a short period of time. I've sent them proof of collection/pick up via the ubereats app and sent them my insurance proof but they decided to reject my appeal due to me leaving my vehicle unattended for 5 minutes....!??? How else am I going to collect an order??? This is truly unbelievable from Tfl.

I now have to go through the London tribunals...Grrrr >:(

What do I write in section 6 of the tribunals appeal form?

Will the adjudicator already have the evidence I've sent to Tfl in my first appeal like proof of pick up/ collection and proof of hire and reward insurance etc?

I surely have a strong case, right?

I've read on the London tribunals website on their key cases section that "No person shall cause or permit any vehicle to wait during prescribed hours
in a restricted street except…. For so long as may be necessary for delivering
or collecting goods or loading or unloading the vehicle at premises adjacent
to the street"
Also on the Tfl website it clearly states that you are allowed to leave your car in a loading bay: "If you leave the vehicle unattended try to make it obvious that you are loading and unloading" which i did by holding the food delivery bag....!

Also the wording in the rejection letter is incorrect by calling me a self employed carrier and not a courier and also tip instead of trip....??!!

Please advise....
