Yellow Box Junction - Havering

Here is the timeline so far:

03.07.2025 PCN issued to lease company for alleged contravention 07.06.2025

I then received a PCN around September 2025 and lodged an appeal.

My appeal was:

I wish to appeal this PCN on the following grounds:

1. I stopped to allow a vehicle to pull out of the side road. I was not stopped due to the prescence of staionary vehicles. This is not an offence

2. The box illegally extends to the far side of a T junction

3. There were no signs to indicate the 31j no stopping restriction you have accused me of and the highway code makes no mention of not stopping in a yellow box. Please confirm how iIwas supposed to know the existance of contravention code 31j prior to the offence?


I received no reply.

On 12.12.2025 I received a charge certificate. On the same day, I emailed Havering saying:

Dear sir or madam,
 
I have received a charge certificate for PCN HG6232941A despite the fact I have already appealed it and received no response. Please see the email below. I therefore request that you cancel the charge certificate and respond to my appeal.

on 22.01.2026 I recieved the following email:

Good afternoon.

Please accept our sincere apologies for the delay in responding. We are currently experiencing a high volume of emails.

A letter of rejection was sent on the 10/11/2025 I have attached a copy of this letter.

Please be advised, as a Charge Certificate has been issued you are no longer able to make representation against the case as under the Traffic Management Act 2004, service of a Charge Certificate removes the right to make representations against the case. Please wait for an Order for Recovery which will enable you to make a Witness Statement  against the case on one of the following 3 grounds only.
1. You did not receive the Penalty Charge Notice/Notice to Owner / Enforcement Notice.
2. You made representation against the issue of the Penalty Charge to the local Authority within 28 days but you did not receive a response (Notice of Rejection).
3. You appealed to the Parking & Traffic Appeals Service against the local Authority’s decision to reject your representation within 28 days, but you received no response to your appeal.
Please wait for the Order for Recovery to be served. This is the only option available to you outside of payment of the current outstanding balance of (check balance) for each Penalty Charge Notice. This is a Quasi-Judicial process as laid out in the Traffic Management Act 2004 that must be followed by both the London Borough of Havering and the appellant.
Should a Witness Statement be accepted, the Charge Certificate surcharge will be removed and you will be able to either make formal representation or pay at the  full charge.

I'm confused, the letter and video are in respect of a bus lane, not yellow box junction.

So - your representations set out a valid and legitimate defence, you didn't have to stop due to the presence of stationary vehicles as the car you stopped for was not stationary when you stopped in the box.

If you can get back in the process and see this through to adjudication you ought to prevail.

The next step is to wait for the Order for Recovery and follow the process as set out there.  That should get you back to the PCN stage and you can apply for a tribunal hearing where someone who actually understands the law will consider your case.

very handy that havering have kindly admitted I writing that the other vehicle wasn't stationary
