No fingers crossed at all. It's the law.

Now, whether Worthing are now up to speed on the law I don't know. My only interactions were 2-3 years ago for my daughter-in-law. We won both and got costs awarded against them for the second.

At that time their obdurance was matched by their ignorance.

Let's see how they treat you.

If they play silly b*****s then, as I make frequent trips to Worthing and I'm retired with time on my hands(at least outside school holidays), I might just observe the conflicting situation within that zone(which might be repeated elsewhere for all we know) and write to them. But not until your* PCN has been determined.

*- on this point, are you the registered keeper with current DVLA details.

Do they have time limits for replies? I didn’t know? I’m glad they were late as I’ve been moving and I’m in so much pain I can hardly think, although I can hardly think straight on a good day! 😂. Just to add to my distress, I parked in Iceland car park (nearest) paid my pound, didn’t refund at till as I was delayed due to spasms of pain, I had to sit & take pain relief before returning to car, unbeknownst to me I was 12 mins over & they’ve sent me a ticket too! 🤯

There is a legal limit on replies to representations against a Notice to Owner of 56 days. However, in your case, this is a reply to an informal challenge against a PCN, and there are no legal limits. However, there is a legal limit on service of a Notice to Owner of 6 months from contravention date. So they've already used up half of this.

Would an adjudicator consider the delays such,  as to make it an abuse of process to proceed with enforcement ? Well, you'll only find out by taking them all the way through the process !

Still I have not received any further correspondence regarding this ticket? After moving I set up a mail redirection to ensure I get my mail. I'm hoping I can forget about it, what are the chances that they don't want to process it?

Worthing's website says they have sent a notice to owner.

You need to call Worthing tomorrow and ask what the status is of the PCN.

When did you move and have you updated the logbook.

Don't worry - as long as it hasn't gone beyond a debt for recovery deadline you have automatic recourse to get this sorted.

You moved when?
You set up mail redirection for how long?

The council are the tardiest aren't they!

Anyway, they had until 7 Feb. 2025 to serve the NTO otherwise they're timed-out.

2) A notice to owner may not be served after the expiry of the period of 6 months beginning with the relevant date.

....
d)in any other case, [the relevant date] is the date on which the relevant penalty charge notice was served under regulation 9.

 

So, find out from the council the date the NTO was issued. Just this, don't discuss anything else.
