Hi,

I had driven into the restricted road as indicated by the diversion sign. The diversion sign can be seen in the image but unfortunately it is only the back of the sign. If it helps, I wouldn't usually drive this route and only did so due to the diversions (although not sure how to prove this other than giving my usual route).

The link above shows the current roadworks going on. Usually I would go through Longley road to Blackshaw road but because of the works and diversions I was routed to Sellincourt road

I just wanted to know if it is possible to dispute this due to the circumstance or if I should just pay the 80.

Thanks.

What date is the contravention.

This was reported on Saturday but presumably before this.

Post the PCN.

- heres the pcn

Happened on 13/03

That was just the day before the report so you must have a solid case. Back of typical diversion signs can be seen.

So just to confirm, you're saying I should try to dispute? Also, where is that screenshot you sent from?

Yes you should challenge if you're sure the diversion was signed as an alternative to your route.

The screenshot:

There is a problem with the wording on the PCN.

The law:

(v)that, if the penalty charge is not paid before the end of the 28 day period, an increased charge may be payable;

Please the rest of it i.e. the PCN.

This may be technical BUT there are valid arguments concerning this. We has one cancelled yesterday - DNCed.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
