Hi all,
Clutching at straws here with this one, but thought I would get your thoughts in case I missed an angle for a counter argument.
I live within a 'close' that shares it's parking with it's residents. It is not clearly displayed that it's private parking, and so in theory anybody is able to park in this area.
One evening I come back home late, and I notice that another car has parked in the spot where I usually park, (it must be a guest of one of the residents), leaving me with no choice but to park on the road.
My intention was, to move my vehicle before the parking restrictions come in to force again the following morning at 9am. Of course, I forgot to do this and so was issued with a PCN from the council citing: Contravention Code: 12 - Parked in a residents` or shared use parking place or zone without a valid virtual permit or clearly displaying a valid physical permit or voucher or pay and display ticket issued for that place where required, or without payment of the parking charge.
For reference, this is where my vehicle and other residents vehicles are parked normally -

https://goo.gl/maps/HkJsSLSknKLBv3aHAI'm wondering if I have any grounds to challenge the council with this, given that someone else had actually parked in an area designated for residents only - albeit there are no signs to say so.
