Draft, grateful for thoughts please then submit this Sunday:
I am writing to ask TfL to exercise its discretion and cancel this PCN following consideration of the circumstances shown in the CCTV footage.
The driver was looking for somewhere to stop as they were travelling with a baby who needed to be fed. The driver initially manoeuvred into the space, with approximately the first 30 seconds of the footage showing the vehicle still reversing into position.
Once the vehicle had stopped, the driver checked the nearby signage. On seeing the restriction and the applicable times, the driver realised that stopping there was not permitted at that time and left the location shortly afterwards.
Importantly, no passenger exited the vehicle. The CCTV footage shows no loading, unloading or other activity taking place. The driver stopped in order to check the nearby signage and establish whether stopping was permitted at that time. Having read the restriction, the driver understood that stopping was not permitted and left shortly afterwards. The stop was brief and arose while the driver was trying to find a suitable place to stop and then checking the signage to establish whether the location could be used.
I would respectfully ask TfL to consider the circumstances of this particular stop, including the fact that the driver was actively checking the signage and, having understood the restriction, took steps to leave rather than deliberately continuing to stop there.
The supplied CCTV footage is one minute and 28 seconds long and does not show the vehicle leaving, but it does show that nobody exited the vehicle and that the vehicle was only stationary for a short period after the initial manoeuvring.
In light of the very brief nature of the stop, the driver's attempt to establish the applicable restriction, the presence of a baby requiring feeding, and the fact that the driver left once they understood that stopping was not permitted, I respectfully ask TfL to exercise its discretion and cancel the PCN.
If the representation cannot be accepted, I would be grateful if TfL could explain why the circumstances shown in the CCTV footage do not warrant the exercise of discretion.
