TFL PCN - tunnels (Blackwall) - Bailiff

I never recieved a PCN. They went to my old address. This Notice of Enforcement is the first correspondance recieved, on thursday 8th january.

Today (12th january) the bailiff visited but only stayed long enough to post the letter and ran.

 31st may I went through the Blackwall tunnel. Went to pay that evening and got suckered into autopay. I read it as you have 3 days to pay and autopay will cover it. By the time I set up the account, it was 1st June. Read up to the tab to sign up. Believed I'd covered my trip and it was paid for by autopay.

After calling TFL on thursday, they tell me thats not the case and it's out of their hands now.

I updated my driving licence the day I moved in 2021. I believed I updated my V5C when I went to pay my tax the following year (I also wrongly assumed the driving licence and V5C updated together and I put my current address when paying online). Couldn't find V5C to pay this year (not sure why I looked for it this year when I didn't from 22-24), so requested a new one in august.

Called DVLA. They tell me I updated in 2019 and august 2025. Mortified.

 Now about to recieve Statutory Declaration. In short the V5C allegedly had my old address till august 2025. Yet 2 months passed till the Warrent of Control was issued and still no letters from TFL.

Do I have a defence?

What do you mean by this ?  Surely you are going to submit a Statutory Declaration to t he Traffic Enforcement Centre ?
Are you up-to-speed on SDs ?  With a bailiff letter received, any SD submission is out-of-time, so must be accompanied by another form to request permission to submit the SD Out-of-Time (OOT). Forms involved are PE2 and PE3

Because you will be submitting OOT, TfL can object to its acceptance, and will do so. You have to explain why you did not receive the PCN, and failure to update one's V5C is not an acceptable reason. At the moment, all the bailiffs have added on to the debt is the £75 Compliance Fee. This is a statutory amount, they don't make them up, but of more importance is that if you fail to pay, they could visit your address and add on a visit fee of £235, again a statutory fee. In cases like yours, where the matter is at the Compliance stage, and from your narrative, normal recommendation is to pay the amount demanded. This has no impact whatsoever on whether your SD submission is accepted, although I have to tell you that success with it is unlikely. Sorry if this isn't what you wanted to hear, but it is reality.

The OP has had a bailiff visit and owes £590.

So you got the enforcement notice on 8 January at your current address?

The EN is dated 27 December though so for some reason you've not been given much time to act as the bailiff came yesterday.
