TfL PCN (claimed) non payment

TfL have sent me a PCN in februrary, which is actually ok, I ****** up.

They are sending more letters saying that due to non-payment a charge certificate has been issued and its now £240.

However, I have legal proof of payment (a literal receipt) and bank statements showing I paid this within 8 days of receiving the PCN. TfL are disagreeing that I paid the £80 (that has already been paid) and are now wanting the full £240, meaning I will be £320 out of pocket.

I literally have a receipt showing it was paid, I made a representation and sent them al the documentation proving this and they have investigated and to the surprise of nobody, are insisting it has been issued correctly.

What are my options? I have legally paid this with proof and tfl are having none of it.

Their own system even shows it as paid at the start, and the same PCN is now £240 outstanding having already paid the £80



TfL are claiming they refunded it for some reason, however I never received it.

I provided the receipt I got from them for the payment within 6 days of receiving it, along with a bank statement covering 3 months proving that I never received the refund.

TfL are claiming the refund was sent, although there is no evidence of this - I have spoken to my bank about it as well and they have had no evidence of a payment even attempted to be made.

I provided all this evidence in my "representation" to tfl by post as they require but they are still insisting this has progressed correctly, but it seems they have had a system issue as there is no evidence the refund was issued to my bank.

I have written to my MP as well to see if there's anything they can do as it just feels like TfL are bullying someone who complied with their obligations into capitulation.

Give us the PCN number and number plate please.

I think the best way to deal with this will be a formal complaint, but we might as well check a couple of things first.

I just thought I would update this, I wrote to my local MP and provided a document full of evidence of TfL screwing this up.

A few hours after he read it and sent a letter to Andy Lord (TfL commissioner) and a few hours later I got a chap from TfL call me up and called it, and I quote, "a complete shambles and it should never have happened, there are multiple failures here including the PCN progressing while it was on an on hold status, as well as the refund they claim never actually successfully going through".

A comedy of errors, with the end result being TfL have now cancelled the PCN and are going to refund me the original fine I paid as well, for the inconvenience and stress caused.

As I did make an appeal through the official TfL process and got denied, I am debating going through with an foi request to see why it got denied. It shouldn't have, and the guy that called me confirmed as much.

Final update: I have an email in writing from a TfL representative:



Further to our call yesterday, I’d like to apologise again for our handling of this penalty and the inconvenience this has caused you.

In light of this I have arranged for the penalty to be cancelled. No further action is required by you and the £80 payment will be refunded back to your card in the next five days. As discussed I will also send you an additional payment of £30 as a reflection of the inconvenience caused.

I appreciate it doesn’t excuse our handling of this, but I have asked that the handling of this be fully reviewed in order to prevent any other motorists experiencing the same problems which you have

If I can be of any further assistance do not hesitate to contact me directly.

Contrition from TFL is pretty much unheard of.
