TFL - O/S 28, 30 BUCKINGHAM PALACE ROAD SW1W

I am a Private hire driver. The vehicle is under hire to me (less than 6 months hire agreement).
I had a pre-booking and waiting for a passenger, however the booking ended up being cancelled.

*The letter is from about slightly more than a month ago as I was waiting for the footage from TFL which I requested multiple times. Third times the charm

Have you proof of the booking and its cancellation ? If one submits reps on the basis you are a PHV waiting for a customer,  it is essential to provide some collateral to support your representations

PCN issued 15 Oct, therefore unless TfL extended your 28-day period for appealing then you're too late to submit anything.

When did you receive the DVD and in response to the date of which request? Was the DVD accompanied by a letter? Have you anything from them indicating that the enforcement clock has stopped?

I have asked them every time i called to put the PCN on hold and they agreed.

I first called on 20/10/2025

Second Time i called on 03/11/2025 followed by this letter around 2 days later: https://imgpile.com/p/JDO1dH4

A letter would have a date, but none is visible in your link.

Anyway, all you can do is submit reps ASP.

(a) the alleged contravention did not occur.

(b)the recipient—

(i)never was the owner of the vehicle in question,


As regards the contravention ....whatever you have to say...

As regards the issue of ownership, I am not the registered keeper and I contest that that this person was legally permitted to seek to transfer liability to me as the 'owner' and this is supported by their failure to effect this in the prescribed manner, including supplying the authority with the documents mandated under the regulations. If the authority claim that they are permitted to treat me as being the 'owner', then in any rejection they must provide the proof provided to them by the registered keeper. Simply asserting that everything was conducted in accordance with the regulations would be insufficient, particularly as this evidence would have to be produced at adjudication.

Also, are you saying that i should appeal based on the ownership paragraph only or
My appeal + ownership.

Dear TFL,

The contravention did not occur. I am a PHV driver and I had received a booking to pick up a passenger at this location. The booking was made at 08:36am and I had arrived at the location at 08:42am where the passenger should have been waiting for me.

1. Should i attach the screenshot of the booking cancellation?
2. What option should i choose from the appeals page? I have these options:

- The Contravention did not Occur.

- The Traffic Order was invalid.

- I was not the owner/keeper at the time of the Contravention

- The Vehicle has been taken without my consent

- The Penalty has been paid in full, or has been paid at the reduced amount within the specified period

- The Penalty Charge exceeds the applicable amount.

- We are a Hire Firm and have supplied the name of the hirer.

- There has been a procedural impropriety on the part of the Enforcement Authority

- Any mitigating circumstances you wish to raise

Use the exact wording provided by HCAnderson, no need to add anything else. He deals with these all the time. Keep it short and to the point, don't provide any ammo they could use to shoot yourself in the foot.
Bus driving since 1973. My advice, if you have a PSV licence, destroy it when you get to 65 or you'll be forever in demand.
