PCN - TFL hiked fine to £240! Code 62. No rejection email!

Hi looking for help on this. Basically I parked my car on the petrol forecourt drive whilst engine was playing up on the way to the airport to pickup my nephew. Eventually car was ok and I drove off.

Received the TFL PCN back in December 30th, appealed and told them situation, (within the time allocated), they took email and said would notify by email of acceptance or rejection. If rejected I was happy to pay the initial £80.

Waited for this email...Nothing, nada, not even spam folder, then received the charge letter thru mail for £240!!!!

I did some research stating that I can wait for recovery letter and then apply for PE2/3 form and make a stuatory notice for not receiving ANY email/notification.

Is this now the best route?

It's not those forms because PCN is under the Traffic Management Act 2004, so you need to submit a TE9 Witness Statement. When TfL send you the Order for Recovery t hey will include this form with it, (or should do !). You can also download it from the TEC website.

Thank you Incandescent for your prompt reply! Great, I shall wait for the recovery letter and then submit the TE9 form as you've said. Should I also give them, (TFL), a call to make them aware of the situation? ...and how cheesed off I am! Or just wait for recovery letter, because I'm happy to pay the original £80 as the appeal was rejected.

Check the PCN status, and when the amount goes up by £10, they have registered it.

I have now downloaded the TE9 form and am ready and waiting for it to go up by £10.

Can I not fill the form in now and send it off?

I mean, why do I have to wait for the recovery letter?

Sorry, am new to this.

The form is for the administrative court, not the council. They won't be able to action it until the debt has been registered with them.

Just to make sure you understand, you will need to send in TE9 again once the debt is registered

Aaahhh ok got it, Thanks Neil! So just to be clear! Send it only once and only when the £240 becomes £250 so I know the debt has been registered!

May I ask what happens after this process?...and how long it takes to finality lol

TEC used to turn these things round very quickly, but no more ! so it could be some days before they cancel the Order for Recovery and the Charge Certificate. BTW, when filing in the form, the 'Applicant' (see top right of form), is the council.
The original PCN is not cancelled, and the process reverts to the stage you submitted reps but got no response. So the council are obligated to pass the matter to the adjudicators who will decide what to do.

Thanks for letting me know Incandescent... ESPECIALLY for pointiing out which box to tick because I thought it was the bottom left of the form!! Appreciated mate!

I can't believe how many people they con with this 'notify by email' business, as I've seen quite a few people have had no email notifications sent to them. It's a good thing you guys and this forum exists to help out singular cases!

Yes. It'll get the matter back to that stage, and based on their response, you should be able to pay the sum on their rejection email, or register an appeal at London Tribunals. Of course if you take them there the full PCN penalty will be in play.
