TFL Code 46:Stopped where prohibited (on a red route or clearway) Stoke Newington High Street N16

Hello,

Parked in the red route box with a blue badge, and thought i was within operating hours, when i got out of my vehicle i noticed that it was only till 1PM, by then my daughter entered a shop, so i entered the shop to tell her i need to move and went back to my vehicle to move away.

I explained this to TFL by way of an appeal and checking online it got rejected, I did not receive any communication by post nor an option to appeal to the adjudicator.

I called them twice and no luck, i asked and I was not given an email how to contact them.

Can anyone please advice or give some recomendation how to proceed.

Please post up your reps and their reply.

AFAIK, you should have received a paper letter of refusal of reps.

The next stage is to register an appeal at London Tribunals.

I did not receive any letters or emails from TFL.

Can I still appeal even if i do not have their appeal form?

If you could go onto their website and download the event log for your PCN, it would help.  At the moment we haven't a clue where you are in the process, other than you've told us you enquired online and it showed rejected.

It would be best now if you register an appeal at London Tribunals, and state grounds of "I rely on my formal representations to Transport for London". As far as I know, you don't need the paper form from TfL.

How do I appeal to the tribunal if I do not have any document from TFL.

5th June they decline your reps, so it looks like their letter of rejection has been lost in the post. This is not unusual these days, and sometimes letters turn up weeks later.  They have re-offered the discount, but I suspect the time allowed to pay has expired.

So best to register an appeal now.  However, bear in mind the PCN time is well within the estricted time period so I'm not sure what you think you can appeal on.  There may, of course, be a 'technical appeal' and hopefully somebody will come on if there is one.

Contact London Tribunals to explain that your reps against a TfL postal PCN have been rejected according to their PCN event log, but you have not received their letter of rejection, which seems lost in the post as the rejection is dated 5th June.

YOu could also contact TfL as well to find out when their letter of rejection was sent out. This letter must be sent by mail.

IMO, you cannot appeal because you have not received a notice of rejection of representations, neither are you in time to make a statutory appeal but instead would be relying on the adjudicator's powers to register an appeal submitted late which rather presumes you know what this needs to include(which is reasons for lateness)!


If date of posting the NOR was 5 June then the 28-day appeal window opened on 7 June and closed on 4th July.

IMO, you should let the process play through i.e. Charge Certificate, Order for Recovery and then witness statement.

It's not your task to chase TfL, their legal duty is to consider and respond by post. Can we presume that nothing was included in your reps - which we've yet to see- regarding addresses for their response?

And pl get hold of their camera evidence.
