I always park outside my house on a single yellow before the restrictions start I move my car. This is the first time I’ve received a pcn here which I think it’s because of the drop kerb to my own garage. Any luck here?

If you were blocking your own driveway, then you should submit reps on that basis. Looks like a new CEO may have been allocated to that particular patrol. Basically, one can park blocking a driveway with the resident's permission.  Question is, why not just park your car on your property not in the street ?

Looks like you are parked across two garages including one that says no parking - could your neighbour have called the council to ticket you?

Get a statement from in-laws saying they give you permission.

As for their PCN, where exactly was their car.

Note that although the garages may be too small for cars they can accommodate motorbikes.

I should have said post your challenge here first - what was it?

The legislation is clear that this is an exception to the contravention:

The second exception is where the vehicle is parked outside residential premises by or with the consent (but not consent given for reward) of the occupier of the premises.

This exception does not apply in the case of a shared driveway.

Sorry. I just said I parked in front of my own house. And gave evidence of living there.

I don't think they could argue it's a shared driveway and they're not saying that anyway.

The law says their rejection is wrong.

I would go on with it but see what others say.

My view is that the OP should take them all the way to London Tribunals if necessary, but we don't yet know the ownership of the car in relation to the next stage, the Notice to Owner, which is sent by post.

At the moment, the OP has submitted an informal challenge, and received the usual Fob-Off letter sent out for almost all informal challenges. Most people never take matters further and pay the discount, thus reinforcing councils in their essentially unlawful practice, like here, where the car was lawfully parked on the dropped kerb.

So if the owner can tell us whether he owns the car, and the V5C is up-to-date matters can proceed.

OK, so if you are prepared to stand your ground and take them all the way to London Tribunals you now need to wait for the Notice to Owner. This will be sent to the address on your V5C, so check it is totally correct as you don't want to miss it.
