I've been served a penalty for failing to comply by entering a zone with a prohibition for motor vehicles.
I was driving on a Thursday afternoon at 2pm.

As can be seen on the pictures provided by the council that the main sign of warning is on the right hand side. I find that very misleading as it should've been placed on the left hand side (imagine a bus driving through on the other side, that would make the sign not visible)

There's a sign on the left hand side a bit further along but that's already after the contravention has been recorded.

Is there anyway I could fight this?

Errr???

Have a read of https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/read-this-first-before-posting-your-case!-this-section-is-for-council-tfl-dartme/

and please post the pictures here together with a GSV link to the location

EDIT - I see the pictures are included in the .pdf file. Please post the GSV link and the remaining pages of the the PCN, as the small print needs to be checked for mistakes.

Please do not start new threads for the same PCN.

The Google street view image shows a sign on the nearside:

Now, it might be that the nearside sign has gone missing, in which case your case is quite strong, or it's there but just out of sight of the camera, in which case it's quite weak and you'd need to look at the strategy of last resort instead.

The only way to know for sure if the nearside sign is still there or not is for you to go back and check (if it's gone obviously get some photos).

The traffic order is The Hackney (Prescribed Routes and 20 Mph Speed Limit) (Consolidation No.1) Order 2019 as amended by The Hackney (Prescribed Routes and 20 MPH Speed Limit) (Amendment No.61) Order 2023.

I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

Hi, I am in a very similar situation, just received the PCN for 52m at the same location. I was wondering if the OP has appealed and what was the outcome.

Any advice is greatly appreciated.

Thanks!
