Hi all,

Newbie here. I have been recommended this site to gain some further advice on a recent ticket that I received from London Borough of Hounslow.

Firstly, there was no prior warning or any notice to the customers or community for the recent parking restrictions that have been put in place and enforced by the council.

The restriction in place and what this means: basically the parking remains free for the first 3 hours and then £3 payable from 4 hours +, but customers need to register this on the paybyphone app. The restriction also runs from Mon - Fri 8:30am - 4:30pm.

Secondly, the signage throughout is not very clear or in fact adequate enough. There is one main sign to the right corner of the main entrance, which is slightly at an angle, and this can easily be missed if entering from the left side. There was also no signage in the area that I was parked.

Currently, I have made challenge online but this was declined, in a nutshell "we have considered what you say but we have declined not to cancel your parking ticket"

I am still awaiting for the NTO to arrive.

I have checked the regime and it's max 4 hours stay, first 3 hours free but 4th hour is £3.

We often see the nonsense contravention of not paying the 'free' parking charge, as I expect you were in the 3 hours.

What was your challenge, and post their rejection in full.

Yes you are right re the regime, I have updated my post to reflect of this.

Yes I was well within the 3 hours - I arrived onsite at 8am and left at approximately 9am after my yoga session.

I cannot find my original challenge in which I made through the council portal, however, I have a copy of my 2nd response in relation to their response, which follows down below.

Councils response: " Thank you for writing to us regarding the above Penalty Charge Notice.
We have carefully considered what you say but we have decided not to cancel your
Penalty Charge Notice (PCN).
You were issued a PCN for not paying to park. You were parked in a bay for people paying
to park by phone or online; however, the Civil Enforcement Officer (CEO)'s handheld
computer showed no payment to park.
The enclosed photos help to show why your PCN was issued.

You have these choices:
• You can pay the discount charge of £55.00 if your payment reaches us within 14 days
of the date of this letter.
• You can pay £110.00 within 28 days of the date your PCN was issued.
• As you have made a challenge (informal representation) you can still make a formal
representation against your PCN by using a Notice to Owner form. The vehicle's
owner will automatically receive the form if the PCN has not been paid within 28 days
of its issue date. If you decide to make a formal representation against your PCN,
please do not write to us again but wait until the Notice to Owner form arrives. When

the form arrives, it will be too late to pay at the discount rate. The form will guide you
through the representation and/or payment options. Should you make a representation
that is not accepted, there is a further option to appeal to an independent parking
adjudicator at the Environment and Traffic Adjudicators. This will be explained in our
response to the representation. You must go through the process of making a formal
representation with the Council before exercising your rights to appeal. This will
enable the independent parking adjudicator to determine whether your case has been
considered fully by the Council.
How to pay:
• online at www.hounslow.gov.uk
• by phone (24 hours). Please have your credit or debit card and Penalty Charge
Notice number (see above) ready. Then call 0333 800 0107.
• by post Please make your cheque payable to 'London Borough of Hounslow', write
your Penalty Charge Notice number (see above) and vehicle registration on the back,
then send it to: London Borough of Hounslow (Parking Services), PO Box 211,
Sheffield S98 1NG.

My response " The pictures supplied does not clearly reflect the parking restrictions within the area that i parked in at the leisure centre.

As per your above advice, I still wish to make further representation against this parking charge notice which will overrun the discount period. Please can you explain the process of this if the further representation is declined?

Ultimately, the parking restrictions enforced on this site is a fairly new enforcement and therefore not every customer is aware of these procedures going forward, firstly of which I wasn't aware of.

Secondly, the pictures supplied on your response also does not clearly reflect on clear signage being made clear with each applicable parking space available on this site. As my picture attached doesn't show any clear signage near to the point of my entry or parking space.

From speaking with a rep at the leisure centre today it appears that a parking restriction has been in place for a few years. However, this paybyphone process is something which has been put in place within the last few months. I have been a regular customer of Fusion/ Lampton Leisure for several years, and having attended Heston Leisure centre more regualry over the past 2/3 years and haven't once received a ticket.

Reasons   Mr xxxxxx's evidence is that this car park has free parking for up to 2 hours and this is supported by evidence of a zero charge for previous parking sessions. Mr xxxxxx has explained that he was unable to register parking through the Pay By Phone app as his phone was not working.


The Council does not dispute that there is free parking for 2 hours. Whilst Mr xxxxx's car was undoubtedly parked without a valid telephone session via Pay By Phone, it was not parked without payment of the parking charge as there was no charge payable and it follows that the alleged contravention did not occur.

So do I have a case here ?
