Southwark council dulwich village 33e Burbage road
« on: »
Hi everyone.
Unfortunately I went through the bus gate on Burbage Road one day, this is a day that there were road closures on rosendale road which was causing a stupid amount of traffic around the area.
I went onto burbage road without noticing the that the time was when a restriction in force.
A genuine mistake, I appealed and asked for discretion but they have rejected.
Is there anything in the rejection letter that i could go on?
I have also posted my challenge in the uploads.
Thank you

You need to check if this sign on the left is still in place & visible: https://maps.app.goo.gl/9NUWtnkgys2tEMCT8

It was there in March but a lot can happen in six months.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

Hi cp.
I have taken the pictures of the sign.
Unfortunately, it's the same as the picture you posted. Is this now a thing that i should just pay the discount?

Sorry to bump this, but I think it's the last day for the discount today,
Should I just pay this?

Kind regards

If you have any mitigation to put forward, you could use the strategy of last resort which is explained here.

Thank you for the reply cp.
I just can't think of anything at the moment to put forward.
I've asked for discretion but they refused,
Regarding point two, I just wouldn't know where to start to give them an excuse to look at an image or video. Especially if the sign is correct.

Kind regards

I have just checked the NOR.  Yes, today is the last day the discount expires.   Mitigation cannot be considered by the adjudicator.  I would pay the discount.  Southwark are very thorough in their appeals - they even send two officers to attend the hearings! :-[  :'(
I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
