Author Topic: Southwark Council – 5 PCNs – one directly disproved – suspected ANPR mis-read – advice needed  (Read 354 times)

Hi all, I’m looking for advice on how to proceed with five PCNs from Southwark Council which I believe have been issued in error.

All five PCNs were issued using CCTV / ANPR and relate to the same general area and similar times. I live near Heathrow and do not travel to or work in the Southwark area.

I am an Uber driver. For one of the PCNs, I have clear independent third-party evidence from Uber showing that at the alleged time I was actively completing a trip in West London. This directly disproves that PCN and makes it impossible for my vehicle to have been in Southwark at that time.

This leads me to believe the registration has been mis-read and incorrectly attributed, and that the remaining PCNs arise from the same ANPR error. Some of the council evidence consists only of black-and-white infrared images, and the other videos and stills are very vague. The vehicle shown is a black Kia Niro, which is very common in London and not distinctive.

On most of the other dates I was not working as an Uber driver and was at home near Heathrow working my other job, which explains why there are no Uber trip records for those times.

I would appreciate advice on whether disproving one PCN is sufficient to undermine the reliability of the remaining PCNs, whether I should challenge all five on that basis, and whether this is the type of case that is commonly overturned at London Tribunals if the council rejects the representations.

I have not paid any PCNs and I am within time to make representations. Happy to upload redacted documents if needed.

Make a list of the PCNs: what they are for, locations, and date of contravention and date of PCN. .

Independently disproved by Uber driver trip record showing the vehicle was in West London at this exact time

From the way that car is driven I would say it's a cloned plate. The driver seems to have no regard for any other road users!  :(

My thoughts exactly but I thought it was a far fetched idea. Now my concern is how I prove that it wasn’t me. I have one piece of evidence on my uber app stating that i was on a trip across London at the time Penalty charge but for the rest I haven’t got anything solid like a screenshot of my location

Do you have an android phone? Google timeline may show where you were.

The two daylight ones offer the best chance of spotting differences - can you see anything on the stills? But these are poor quality videos.

Anything about the numberplate?

But the one you have proof for should get these cancelled as it's obvious this is someone with no regard to the restrictions and unlikely to be a professional driver.

I’ve got an iPhone, unfortunately Google maps wasn’t recording my location. I can disprove the one on the 20th at 9pm as I was on a trip across London but not the 6pm one as I was home

You should be able to report your suspicions to the Met and get a crime number.

You can also ask TfL is there are any PCNs outstanding against yr Reg Mark.

The car belongs to a rental company. It’s a temp vehicle for me as mine is being repaired but I’ll call them on Monday to inform them. I’ve also noticed that i can’t spot the TfL phv badge which might stretch considering the poor quality footage

So they are not your PCNs. I presume they've copied them to you and they are not reissued in your name.

You do indeed need to talk to them about how they're going to deal with these.

If you can get the rental firm to report the clone that would be in both of your interests.

I will definitely inform the rental company on Monday and ask them to report it to the police aswell
