Hi,

I parked my car in a bay where there was no restrictions and the sign was completely white which led me to believe that I could park for free. I parked and went away for a few days and came back to find two PCNs on my car and the signage was still the same, with no restrictions. How can I appeal this? I have uploaded the link for the images of the pcn and the pictures of the car I took.
Just in case the PCN no is:JK19060785 and JK1905122A
And the VRM is: MV58JYL

Well, obviously there are restrictions or you wouldn't have got the PCN !. However, the sign giving the restrictions is vandalised and totally unreadable. GSV shows it as saying permit holders only. Councils are under a duty in Regulation 18 of The Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 to place adequate signs giving restrictions defined in a Traffic Order, and to maintain these signs as long as the traffic order remains in place. See 18 (1)(b) :-

Vandalised signs like this should be reported by the CEO patrolling the area, and enforcement cease until the sign is again readable. So I suggest this form the basis for your representations to the council. Do be aware that they will refuse any reps you submit, and to get an unbiased judgment, you'd have to take them to London Tribunals and risk the full PCN penalty. It's this or pay the discount, basically. Councils game the system ruthlessly to keep the money rolling in so refuse all reps, knowing that >95% of people then cough-up. Is this you ?

Yes this is me, do you think that it’s worth it to go to tribunals then if they reject my rep

If it were me, I'd take them all the way, but it's your money and the full PCN penalty is in play at London Tribunals. Do note, however, that there are no additional costs, just the PCN penalty if you lose. Of course if you win you pay nothing.

You have to be careful with vandalised signs.

First thing to check is that this is the only sign in the bay, which it is from latest Google Maps view?

Then why did you park there? Do you live there?

Have you had previous PCNs cancelled there or nearby for the same reason?

Reason being if you were well aware of what the sign is it's not necessarily plain sailing.
