There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

According to you, 1-2 weeks in advance of moving house you notified DVLA with a request for a new V5C on 4 March 2023 because yours was 'lost, stolen, damaged or destroyed'. Pl explain.

You did not receive a response.

You did not follow up with DVLA as required.

6 months later a PCN was issued to you at the 'old' address for a road traffic contravention.

Objectively, IMO the fault is yours. You had the legal duty and more than adequate time to get back to DVLA when your V5C was not received. But there's no evidence you did.

So, IMO even if you got the council and TEC to agree on the what, the why would still represent a considerable hurdle.

OP, you're correct as regards process. Let's focus on what might be more productive areas for consideration having regard to the fact that bailiffs' fees dwarf the council's penalty. As it stands, you still have the OOT step for which bailiffadviceonline's advice could be crucial.

Agreed, @JunotheCorso we need to understand how the correspondence got to the wrong address in the first place. Have you moved house since 28 June 2022, when the last V5C was issued?

I've found the scan of the letter that I sent via the post.
Have you contacted DVLA again since then? If not, I suggest you do so now.

Royal Mail won't have the letter any more, it's either been misdelivered or lost for good. If it were sitting in a Royal Mail office somewhere, even if the address had smudged or the envelope had disintegrated, it would still be pretty obvious where the contents need to be delivered to.

At this point I think all you can do is draft an OOT based on the timeline of events, you'll need to use forms PE3 and PE9.

Type up some draft wording for PE9 and put it on here for review.
