Signage Missed
« on: »
Received a PCN 52M Hammersmith and Fulham Council

First time I have used the side roads around Wandsworth Bridge Road. Had to use the Sainsbury’s then relied on my Sat Nav to get me back en route.

My Sat Nav wasn’t aware of the restrictions and I did manage to stop myself from entering the “no motor vehicles except residents etc” areas
Driving on Langford Road,  no warning signs I shouldn’t turn right at the T junction with Broughton Road.
At the junction there were no signs to indicate to those coming from Langford Rd that they shouldn’t turn right

There is a sign on the road that I missed  (it looks a lot smaller in real life) I was so convinced it was added to the photo and had to look on Streetview to see it was actually there

I admit having looked at the evidence I did drive through these signs but I really didn’t see any warning signage or these signs

I know it looks in the photos that I should have done but

1. Both signs on Broughton Road  are quite high up in the air and were facing in a different direction to the one I was approaching from. I am also quite short and my car is also low so having made the turn I was already on the road I shouldn’t have been and being so close to the signs meant I was never going to see them that far up in the air

2.No idea why I didn’t see the sign on the road. Maybe because when you are low to the ground it again doesn’t give you the view the high up cameras can see

3. This was the first time I have driven down these roads. I was unfamiliar with the road layout and despite realising and looking out for these restrictions I still managed to miss seeing these signs

4. Don’t know if it is relevant but this issue took place on 11th April and I only received the PCN on Saturday 10th May. The PCN itself is only dated on 5th May so already 24 days after the date it took place.

Is this worth fighting. And are the issues I have listed relevant for a defence.

Also what grounds can I put as my defence as I did drive through these signs (just didn’t see them) So the option of the offence didn’t occur or the fine is too much don’t really fit the bill

Extract from the LLA & TfL Act 2003

"Served" means received by the person addressed on the PCN, and is assumed to be two working days after posting unless a longer period is proved. The law is that the PCN is posted by First Class mail on the date on the PCN.
