Salters Hill Failing to give way
« on: »
I felt this was a safe manoeuvre (I know that camera car is there), but I still got a PCN.

Video is here:

PCN first page is here:

Hope that displays properly.

Any advice gratefully received. I'm the grey car (taking mother back from hospital).

We see dozens at this location and we are confident this is not a contravention as you entered the priority area  well before the oncoming vehicle, which hadn't gone over the speed bump. Or at least we think most adjudicators would allow an appeal.

Thank you.

OK, so I will appeal.

I've searched for the process to follow but couldn't find the definitive approach.

Is there a wording to use on this one and is it a straight online response to the lambeth pin address?

I've read here that I'm probably to expect a rejection of my appeal and will have to do a Teams meeting with the adjudicator.

Thanks again.

How does this look for a challenge?

I am appealing this PCN because the contravention did not occur.

I have been aware for years that there is a CCTV camera car observing this junction at most times of the day, so I always approach the give way with caution.
In this case, I deemed it safe to continue under the bridge at the legal speed.
The opposing car does not cross the speed bump which denotes the priority area until my car is almost abreast of it.
The opposing car is not impeded in either speed or direction by my vehicle.
Moreover,  I knew there was a car behind me, so a sudden application of brakes when it would have appeared perfectly safe for me to continue to the junction at Gipsy Road would potentially have created a collision from the rear.

It doesn't matter what you submit, they'll reject it. You have to stand your ground and forego the discount option. So keep your reps short and to the point.

I suggest something like this: -

I rufute the alleged contravention on the PCN because the contravention did not occur.  Your own video shows that I had cleared the priority area well before the the opposing vehicle had even negotiated the speed hump, and that car is not impeded in either speed or direction by my vehicle.

I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
