Richmond upon Thames: "01 - Parked in a restricted street during prescribed hours" - Gothic Road CPZ CR on zig-zag lines


I received two tickets in quick succession this morning for being parked on a zig-zag in a controlled zone - CPZ CR in West Twickenham

I had always be under the (possibly mistaken) impression that the signage meant that parking on that part of the road in August was fine.

Do I have any reason for challenging these - either both, or just one, as it was issued immediately after the first?

For what it's worth, I do have a valid permit (for using in the parking bays).

You were parked on a SYL during restricted hours. No Stopping and No Waiting restrictions can co-exist, I'm afraid.

It is recommended that where a SYL is placed, even within a CPZ, upright sign(s) to this effect should also be placed. I can't see any, pl confirm if present.

Your car was stationary between the PCN. In which case you could submit reps under 'contravention did not occur' and/or 'penalty exceeded...etc.' for the second.

On Maps I can see one timeplate at the end of the line but it is on a bend and should have timeplates at both ends anyway.

Approach here is either to challenge both as a resident and hope for discretion or pay first and ask for discretion on the second. It isn't a continuous contravention by the book.

So in terms of the second ticket, RT47646358, the informal challenge would be that the vehicle was in place for a continuous period, as evidenced by the overlapping observation time of this ticket and ticket RT44666836.

The vehicle had not moved between the two PCNs and remained in the same location throughout. There was no separate or intervening event that could justify the issue of a second duplicated PCN.

In terms of the first ticket, RT44666836, the CPZ signage at all the possible entrances to the zone looks ok, which means that the yellow line is enforceable and doesn't necessary need further signage (unless I'm mistaken of course).



The yellow line doesn't need a timeplate but guidance is to have one when combined with these zig-zags as the same colour is used.

Have you checked what plate or plates are there - I don't think there is one at the end of the line where you parked.

It isn't a continuous contravention as it's not a double yellow but we'd hope you'd get the second at least cancelled.

I would play it straight and say you are a resident well aware of the zone restrictions but simply didn't realise the school no stopping zone also has a yellow line as it seems to be part of the no-stopping marking and there is no timeplate there - the only one is around the bend and traffic signs guidance you now see is to clearly sign such lines separately. If you'd realised you'd have put your car in a permit bay (provide proof of permit).

I am making informal representations against both the above PCNs which were issued at 11.46 on 4th Aug. and 11.51 on 5 Aug. respectively. As can be seen in the CEO's photos, the car was stationary continuously between these PCNs.

As regards this, the first PCN, I would argue that the contravention did not occur. Alternatively, to request that the authority exercise its discretion.

My error was in misunderstanding the meaning of what I now know was a single yellow line drawn through the no stopping prohibition whose restricted times were not those displayed on the no stopping upright sign. This was compounded by the council's failure to follow guidance in these situations which is that, even if, the restricted area is located within a CPZ, to place 'no waiting' traffic signs at the limits of the zig-zags to bring to motorists' attention and reinforce that waiting restrictions also apply.

As regards this PCN, although the waiting restriction is discontinuous my car did not move and I ask the authority to exercise discretion.

Some thoughts.

To answer the question about signage - there's only one end with a sign, and the sign in the middle. The other end has no sign at all.

So what's the deal with continuous / discontinuous? I'm not sure I understand that at all.

Does that mean that an officer could just stand there and issue tickets all day? I mean - why stop at two...

More confusion.

You came for expert knowledge.

'Sign' is an ambiguous term in our field, there must be hundreds of 'traffic signs' prescribed for use, that is to say mandated. Each has its own meaning and conveys its own restriction/information.

Here we're referring to 2 distinct traffic signs: No Stopping and No Waiting.

I accept that things might have changed since the GSV snaps, but at present they show:

A No Stopping sign sited approx. in the middle of the length of zig-zags. This has no relevance as regards adequately signing a waiting restriction;

A No Waiting sign in a parking place situated to the right of and adjacent to the zig-zags. This has no relevance to the single yellow line because its effect is ONLY within the parking place.
