Hi, just looking for some advice on this one. Unfortunately, as I received it on the 23rd Dec and I'm 8 months pregnant I made the mistake of replying before asking for advice here first - I have posted images of the parking ticket and the reply from the council.

details are:
I would like to appeal this PCN because it has been issued incorrectly. The parking contravention it has been issued with is 05 - Parked after the expiry of paid for time. This isn't true. I paid for parking and it was from 11:49 - 13:49 (for a total cost of £6.20). My car was observed from 11:38 To 11:38 - meaning there was no grace period or observation time. At the time the parking ticket was given I was stood further down the street at the pay machine downloading the payment app so I could make payment - for an appointment I had at 11:45 just around the corner (the issues with the app and paying for my parking meant I was actually slightly late for my appointment). I am 8 months pregnant and have been diagnosed with pelvic girdle pain - this means my mobility is restricted and I'm walking a little slower but I was going as fast as I could. I parked my car, exited my vehicle and was downloading the app at the time the parking ticket was given. I did not park after the expiry of paid for time - the ticket is wrong. As soon as the app was downloaded and I had to put in my card details (this did mean I had to login to my online banking to get my credit card number as I didn't have the physical card with me) I paid for the parking. 

They've come back and said I was parked past the expiry - this isn't true. I'd paid for parking at a different location that had expired:

I paid for parking on Jersey Street - location 809071.
This was from 09:03 - 11:03

At 11:03 I moved my vehicle from the aforementioned location - Jersey Street - location 809071 - to a new location.

The parking ticket was issued at John Dalton St - location 79972.

A quick google map search shows that Jersey Street - location 809071 - is 1.2 miles away from John Dalton St - location 79972. The drive time between these locations is circa 15 minutes (I stopped at the Aldi on the way meaning I didn't arrive at John Dalton St - location 79972 until after 11:30).

There I was given a parking ticket for contravention 05 - parked after the expiry of paid for time.
I was not parked after the expiry of paid for time. This is untrue.
The ticket has been issued incorrectly!
I had not parked after the expiry of paid for time because I had not yet paid for any time at this new location.
This is the incorrect contravention number AND I was not given the typical grace period to allow me time to pay for my ticket.

Any advice on next steps would be greatly apprecaited.

So, just a summary of events: -

1. You drove into Manchester and parked on-street in Jersey Street, (location 809071). You paid for 2 hours of parking 09.03 to 11.03
2. On or around 11.03 you left Jersey Street and drove to Aldi on Great Ancoats St to buy a few items
3. You then drove from Aldi to John Dalton St, (location 79972) arriving shortly after 11.30.
4. You then purchased parking time 11.49-13.49

So the PCN served at John Dalton St is unlawful because the car was not present in the car park at 11.03, as you were driving from Jersey St to John Dalton St via Aldi on Great Ancoats Street at the time on the PCN.

Is the above a correct summation ?

The key question is - are you willing to forego the discount offer and take the council all the way to adjudication if necessary ? It seems clear that the councils letter is complete tosh based on your narrative. However, you need to be aware that responses to informal representations are never done properly, they just issue a Fob-Off letter knowing that almost all people, (>95%), then just cough up the discounted amount not wanting to risk the additional money. Representations against a Notice to Owner are considered more carefully, because the council know you are serious about your case for PCN cancellation, and also because if they refuse these reps, it is a total no-brainer for the appelant to appeal the matter at the Traffic Penalty Tribunal. This means the council must prepare an evidence pack and also pay the TPT fee. You pay no fees or costs at all, just the PCN penalty if you lose.

Have you got any receipt or other proof of your Aldi purchases ?

How did you pay for the first session at Jersey Street?

The CEO's machine has picked up this session and it seems they should have issued a paring without paying PCN. The time to buy the new session after the PCN time is too long really but the wrong contravention should see this off if sessions ate not transferable to a new location as I don't think they are.

Candid and true. But c'est la vie.

Your mistake isn't the issue, rather it's their competence.

It's the wrong grounds.

This is not a matter of virtual records but a physical P&D ticket.

OP, can we see the authority's photos pl. Also, have you retained your original P&D ticket?

Are you the registered keeper with current DVLA details?

Does Manchester still use physical tickets? No sign of one in the pics.

OP used a PbP app to pay at John Dalton St, so no physical paper ticket for that session. OP hasn't told us how payment was made at Jersey Street.  Surely the main point is that the car wasn't present at John Dalton St at 11.03 according to the OP, it being in transit between Jersey St and John Dalton St. Maybe it was stationary in the Aldi car park, hence my question about any evidence of Aldi purchases.

The authority's reply refers to 'Pay and Display' ticket at least twice?

GSV for Jersey St(6 months ago) shows every traffic sign to be :

Pay at machine
Display ticket.

OP, you'll need to specify whether your parking rights were virtual or real i.e. phone/online or physical P&D ticket.

John Dalton St. and Jersey St. are approx. 1 mile apart.

This looks like nothing more than the wrong grounds based upon the CEO using an inapplicable reference datum i.e. the expiry of parking rights - however evidenced- which have no bearing on the issue, compounded by the authority using an inappropriate frame of reference for considering the OP's initial reps i.e. the expiry of irrelevant parking rights and the associated disregard of the OP's claim to have been in the vicinity and in the process of purchasing initial parking rights.

OP, I understand what you're trying to imply by your reference to your condition and time taken to go to a machine but IMO you should consider in more detail how to explain the gap between 11.38 and 11.49 e.g. where were you parked relative to the machine (same side of the road only a few yards away or opposite side and a considerable distance) etc.

Also, where's the traffic sign in the parking place?
