Redbridge PCN - 11U

Hi all. I have received a PCN - code 11U / parked without payment of a parking charge.

The first hour in this location is free. I thought I had activated a session on RingGo but it clearly didn't go through.

The only avenue of challenge I can see is wrong contravention code as there was no payment due for the first hour.

I am thinking of appealing with reference to - John Carmody v London Borough of Redbridge (2210237357, 24 June 2021)

This PCN was issued for the alleged contravention of being parked in Gaysham Avenue at 11.32am on 5 March 2021 without payment of the parking charge.

The CEO's images show that Mr Carmody's vehicle was parked with a pay and display ticket displayed in the windscreen. The ticket was valid from 11.27am to 12.27pm. The vehicle registration had not been completed. It is not in dispute that there was an hour's free parking at this location with the display of a pay and display ticket.


I allow the appeal because the PCN was issued for the wrong contravention. A vehicle cannot be parked without payment of the parking charge when no charge is payable. The PCN should have been issued for the alleged contravention of being parked without displaying a valid pay and display ticket.



Would this in isolation be sufficient? I know the council will likely reject and it may need to go to arbitration - will it stand up on its own in arbitration?

We've had a lot of these cases - the trouble is councils are increasingly not up for applying discretion while adjudicators often take a hard line on what the traffic order says and will simply say you had to register a session, free or not.

Do you have evidence you were there for less than an hour as going into the second hour means you must pay something.

Thanks for the response.

I have my Google timeline history which shows me at the location from 15:44 to 16:23. I will have a similarly timed 'trip record' in my cars system although that won't contain the location.

Essentially trying to determine if this will have legs at arbitration or not.
