Redbridge council PCN - parked without payment

Hi all, I received a PCN when parked by George lane in South Woodford. I received the ticket at 13:55 but that was minutes after I arrived and was trying to sort out my payment. I don’t often drive so I didn’t have RingGo downloaded so in the time it took to set up I received the fine. I had proof of paying for parking at 14:04 for the hour. Is there any way I can contest this? I understand the odds are against me here but any help would be greatly appreciated thank you!

How long did you pay for as first hour is free.

Where were you when sorting out RingGo.

Post the PCN, no redactions.

I paid for the usual 30p charge for the free first hour and I couldn’t have been more than 5m from the car just by the sign with the code - I didn’t even notice the parking officer by my car

The 30p is a service charge and nothing to do with parking payment.

There are allowed appeals at the tribunal for the silliness of being charged for something free, plus you are allowed time to sort 'payment' out. Not leaving the vicinity helps a lot.

What was your purpose in parking there and how long did you park.

I went into the local coffee shop Tipi coffee to buy some coffee for myself and sister. Do you think there may be reason for this to be overturned?

Apologies I missed the second part - I couldn’t have been parked for more than 10/15 mins after paying it was a quick trip well under the hour

Yes, don't pay it. I will advise you on a challenge - there's no rush as PCN date today.

A two part challenge. Was your sister with you?

I am challenging the PCN on the grounds that the contravention did not occur and that in any case I did fulfil your requirements at this location. I have two points.

1. I took out a RingGo session for the free hour at 14:04. It took me a few minutes to do so as I had to download the RingGo app, register, and start the session for the location, and I did not leave the vicinity of the car. This was a reasonable time to perform this task as it is the method you ask us to use when parking.

2. The contravention of not paying to park did not occur anyway as you cannot pay for something that is free. I only stopped briefly to buy coffee and was well within the free hour.

I enclose the receipts for the parking session and coffee and look forward to your early confirmation of cancellation.

OP, the council's photos show your car parked under the traffic sign*(which is also in evidence). How can you substantiate being 'in the vicinity' when there's no reason for you to leave the immediate surroundings of your car in order to check on the restriction in force?

*- opposite the 'C' of Keep Clear on the other side of the road.

I was being artistic in the challenge - the OP should give us the full story. But appeals are allowed on both time to set up pay by phone and the free parking issue. Together I would be confident of a tribunal win on one or both unless it's a certain adjudicator.
