Author Topic: Redbridge, code 47 Stopped on a restricted bus stop or stand, Barkingside High Street  (Read 59 times)

Looking for parking on Barkingside High Street. I drove past occupied parking bays, turned right into Horace Road and u turned. Turned left back onto the high street and stopped on the left on a bus stop temporarily, waiting for traffic to pass so that i could U turn again. I put on my reverse lights but then saw a person leaving a parking bay on the opposite side. I proceed to drive forward and park in the parking bay.

The council evidence shows me temporarily stopped in the bus stop with my lights on , but the video cuts when my reverse lights come on. There is no further video of me continuing to park in a bay.

I received a Contravention notice.

Do i have grounds to appeal on basis that I did not stay parked in the bus stop?

Unfortunately not, because the contravention is one of stopping, not parking.

However the bus stop is 30 yards long, enough for about 3 buses to stand, but there is only one sign by the sign for the bus stop itself. This is at the far end of the bus stop where the shelter is, and appeals have been won on the basis of inadequate notice of the restriction, because there is no sign for the restriction where you stopped. Against this argument is the presence of the broad yellow line and "Bus Stop" text on the carriageway, telling you this is a bus stop, although this on its own doesn't make it restricted.

In his/her defence, could OP use Schedule 7, Part 6, para.4, (2)(b) of The Traffic Signs Regulations and General Directions 2016, which states:

 “(b)a vehicle which is prevented from proceeding by circumstances beyond the driver’s control or which has to be stopped in order to avoid injury or damage to persons or property;”
