Received a PCN for this offence during restricted hours. The vehicle had stopped in order to turn into a property opposite the school holding an event for the elderly. In order to access the property, the driver needed get out the vehicle to press the buzzer on the gate so that the gate can be opened and the vehicle can enter.  I don't know if there are any exemptions to this PCN but otherwise vehicles can't enter the premises. Hoping someone may be able to help

OK fine. The video shows you stopping, but doesn't actually show what happened after you stopped. So you need to submit reps on the basis of what you've told us, emphasising the process that gives entry to the <hall, rest home ??> Clearly there is no alternative to waiting with the car until entry is requested and then the gates opened.

I cannot see a vehicle entrance immediately opposite and a passenger alighted, not the driver. Would you pl clarify.


Thanks all. For some reason they blacked out the gate entrance. I've uploaded a link from Google maps here of the entrance to drive in although you have to press a buzzer

In this video the passenger got out of the vehicle to press the buzzer. Once the gate opened the driver drove in

Is that a valid reason to stop there? And would the reason be that the contravention did not occur?

THere is no exemption of waiting for a gate to be opened in this case

OP, if you think about it, it would undermine the purpose of the prohibition if a momentary stop to allow someone to alight was a defence because this is exactly what the prohibition is designed to stop i.e. droves of parents stopping only for as long as it takes for their child(ren) to exit the car. IMO, that the passenger wasn't a child doesn't alter the position vis a vis a defence

Frustrating but in essence it means nobody can ever go to the day care centre during operating hours as always need to stop to press the buzzer to drive in.

Have you discussed this with the manager of the day care centre? It can't be the first time this problem has arisen.

Yes. They said should pull over on to the pavement instead of the middle of the road.
In reality I have no idea how that would help

Sadly, their stupidity doesn't help the OP as regards a statutory defence, so it's back to discretion..

Just an update on this.  Redbridge today cancelled the ticket following first appeal that we were turning into those premises. They responded that following this information that there are grounds to cancel the PCN.   Also, since then we have pulled onto the pavement as suggested before turning in and we haven't received another PCN
