*I cannot get this to format correctly despite it being typed out in paragraphs*

Hi all,

Highroad Chadwell Heath (B) on 19/01/25 at 13:09

Just got sent a Charge Certificate for £195.00 (never received the original notice) and have rung council to query and was then directed to the council website to view the footage. I was taking my friend to A&E and from this exceptionally bad angle, it shows me turning left and doesn't show the sudden hold up in the picture from further ahead. You can see at 5 seconds in that the silver car and the black car in front of me both started to move as I pulled out, before both then stopped. I am in the Black Fiesta. I took the corner wide so as not to hold up traffic in the other lane but, alas, it appears it's a harsh lesson. Granted, I am not from the area (never driven this road before in my life) but is there any way to contest this? The yellow box, from my viewing angle, is exceptionally faded in front of my car.


Due to not receiving the original notice, the customer service agent told me to ignore the next letter (which will arrive in around a month) and then, in April, I will receive a letter that will allow me to restart the whole process with the reduced fine. I got the CS agent's name and logged the call time as proof. If there's no hope of contesting it then I'll obviously take my rather harsh medicine, but it's obviously come as a bit of a shock as I am autistic and only work part time - £190 is a week's wages for me and this has really caused me a lot of distress over the last hour.

They've advised you to wait for the order for recovery, to which you make a statutory declaration (free at a county court) that you didn't get the PCN. This cancels everything but they will reissue the PCN.

Are the name and address correct on the charge certificate?

This is an annoying PCN. Others will know if there are other grounds (eg with paperwork) to contest it but the reset comes first.

Bumping this as, finally, I was able to appeal the fact I never got sent the initial PCN and they’ve sent me the “new” original PCN.

With the original post’s information, are there any grounds on which I can appeal?

Well you are stopped due to the presence of stationary vehicles but the box looks a bit long to me and you had cleared the junction by the time you stopped.

What do others think.

Revoking order dated 13 May.

PCN issued 12 June therefore presumed served Mon. 16th.

IMO, it's out of time and invalid:

(2)Subject to the provisions of this section, where—

(a)a penalty charge notice has been cancelled under paragraph 2 of Schedule 1 to this Act; or

(b)a penalty charge notice has been cancelled in compliance with a direction given by a traffic adjudicator under paragraph 4(2) of the said Schedule; or

(c)a penalty charge notice is deemed to have been cancelled under paragraph 7(8)(c) of the said Schedule (deemed cancellation where a statutory declaration under paragraph 7(2)(a) of that Schedule is served under paragraph 7(1)(c)),

the borough council or Transport for London, as the case may be, may not serve a fresh penalty charge notice after the expiry of the period of 28 days from the date of the cancellation of the penalty charge notice or, in a case falling within paragraph (c) above, the date on which that council or body are served with notice under paragraph 7(8)(d) of the said Schedule.

So, just so it’s clear to me, due to the time between 13th May and 12th June being longer than 28 days, the PCN is null and void?

I’m super autistic so apologies if that’s just common sense but I want to make sure paha.

Bumping due to appeal being rejected:

I got a letter saying that the appeal has been rejected due to "We have rejected your representations because your vehicle was seen entering and stopping in a box junction. The highway code advises "you MUST NOT enter the box until your exit road or lane is clear". Having reviewed the case I am satisfied that the driver would have been aware when entering the box junction that they would not be able to exit and therefore the PCN was issued correctly". Your comments and evidence have been noted however this does not mean to cancel this PCN."

I quite literally spoke in my appeal about how the PCN was invalid due to being after the 28 days, as specified here:

(c)a penalty charge notice is deemed to have been cancelled under paragraph 7(8)(c) of the said Schedule (deemed cancellation where a statutory declaration under paragraph 7(2)(a) of that Schedule is served under paragraph 7(1)(c)),

the borough council or Transport for London, as the case may be, may not serve a fresh penalty charge notice after the expiry of the period of 28 days from the date of the cancellation of the penalty charge notice or, in a case falling within paragraph (c) above, the date on which that council or body are served with notice under paragraph 7(8)(d) of the said Schedule.

How on earth can they not mention the entire point I made in the appeal in their notice of rejection of representation? Surely they can't flat out refuse to accept that something was quite literally issued outside the legal timeframe allowed for doing so, especially considering I uploaded the exact images that I did so here?!

 I used to live in Chadwell heath. And I got a pcn here.

TFL:
You can stop in a yellow box junction when turning right if you are prevented from turning by oncoming traffic, or by other vehicles waiting to turn right.

I was going to turn right. So I entered the Box junction to turn right. I appealed on this and won.
