RE: Lambeth PCN - Cleaver street
« on: »
Hi there, could I please get some help on the below.  I was working at the time of this alleged contravention. I was delivering on the red route and parked on the side road with hazard lights on. The parking wardens had seen me making my delivery knowing I’m not gonna be there for long and when my back was turned issued me the ticket.

Would really appreciate any help in appeakling this fine.

Thanks

@DaceyLH7 please give us the PCN number and the number plate, also please confirm:

1) Are you the registered keeper, do you have the V5C and if so, is the address up to date?
2) What were you delivering?
3) Do you have any paperwork like receipts, delivery notes or similar to confirm you were making a delivery?
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

- Its a rental van which is registered to the rental company
- I was delivering packages, I am a deliveryman
- I have attached the delivery note I leave in my windscreen when making a delivery

Do you rent it directly from the rental company? With rental vehicles it is important to contact the rental company as soon as possible to tell them to expect a notice to owner and to request a transfer of liability. The idea is that you then get a notice to owner in your own name which you can challenge, and the rental company is out of the picture. Some rental companies are stupid and just pay the notice to owner as soon as they get it, and if that happens you lose all rights of appeal, so it is of critical importance to ensure this does not happen.

That's fine, but do you have any specific evidence for this particular delivery? Something like a delivery slip, or at least a delivery route?
