Free Traffic Legal Advice

Apologies in advance if I am breaching the rules by posting without a PCN yet. However I am expecting a PCN following an incident which left me in a yellow box towards gallows corner roundabout in Romford.

There are two lanes as you approach the junction on main road, I am in the left hand lane. The traffic light is green, I wait for there to be clear space for my car to proceed to ensure I am not left in the yellow box. As I am driving, the car in the right lane realises they’ve misjudged their lane and swerves into mine at the very last minute. I had to emergency brake to prevent an accident with inches between our vehicles and I was subsequently left in the yellow box.

If I receive a PCN as expected, I will request the video footage which will clearly demonstrate I was forced to emergency stop due to an unexpected obstruction despite my view showing a completely clear lane ahead. There was simply no reasonable endeavours I could have taken to avoid the situation.

I called TFL and two people read me the same transcript, with one advising I will be unlikely to win an appeal. I did speak to one person later who was a little more helpful.

I appreciate I haven’t got a ticket yet but it’s extremely likely. This aside, I would really like to understand if TFL are correct in their response to me or if I should appeal (pending the ticket).

The car is mine, however my V5 is registered to my parents address rather than mine. I contacted the DVLA previously and they advised if I could access my mail then not to worry?

I imagine I ought to update it via the gov website as soon as it re-opens tomorrow to match my home address (as per my driving license, insurance etc.)

At the time I entered the YBJ it was completely clear as was access to the space on the other side of the box.

When the vehicle from the right hand lane suddenly cut across, this caused me to emergency brake (to avoid collision), but sadly left me in the box.

I’ll share the recording as soon as I get it.

You have to telephone TfL and ask them to send you the DVD (they will send it by post) and to put the PCN on hold (they will put it on hold for 14days).
