Hope you guys can help with this one.

* Driver needs to make a right turn to pick up disabled wife just a few yards further down.
* This is a no right turn junction (please zoom in linked foto for signage), so he would normally continue straight ahead for around 100 metres, do a 360 turn on a small roundabout to double-back on himself, then a legal left at the lights from the facing road.
* As you can see, that option is closed to him coz of roadworks.
* Turning left takes him away from where he needs to go, and in any case, brings him back to the same junction that is closed off for roadworks.
* Since there is no oncoming traffic that could cause an obstruction by forcing the driver to wait for it to pass before he can turn right, the driver felt he had no option but to ignore the signage.

Well, you know the rest.
Does he have a viable defence, or cough up? Any advice would be much appreciated.

Forget the discount. You have 28 days from the deemed date of service to make a formal representation. Please also check out the grounds/reasons on their website and take a screenshot. The last case I did I raised the issue that it is rather unhelpful to say the least.

Is this it? None on the left?

22nd October is deadline and the current/well-founded advice is to make a representation on the last day as they cannot issue a charge certificate until the 29th day. Havering and Lambeth do this willy-nilly as they do not understand date of PCN and deemed date of service.  Haven't tested this lot yet on this.

Please read  my signature as I am exceptionally busy but I will assist with this case.

@ALL MEMBERS

I HAVE A HIGH COURT CASE RE JUDICIAL REVIEW BUT WILL DO MY BEST TO ADVISE AND TAKE ON CASES IF AT ALL POSSIBLE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

Thx for the advice Hippo.

Yes, that is the sum total of the signage - 2 No Right Turn signs on the right hand side of the road from my pov. - 1 each below a double set of traffic lights, and nothing at all on the left side of the road.

The white car briefly crossing my path from my left would have had to run either an amber or red light to be in that position while I was already moving, since my lights would have been green at that point. I'd say there was a good chance that they also received a PCN in the post. That car was my only very brief obstruction to my last-minute decision to do a right turn - when I realised that my normal route back was closed off to me. AFAIK, I was not myself the cause of any obstruction to the only other traffic that was following behind me, since I had already made the turn by that point.

What the vid. doesn't show is that I pulled up on the pavement just a few feet further down to pick up my [registered disabled/Blue Badge Holder] wife outside Pizza Express. She's on crutches (post-op knee replacement), and cannot stand for more than a few minutes without considerable pain/discomfort. That was uppermost in my mind when I made the decision to ignore the signage. Enforcing the signage when major roadworks are in progress and no obstruction was caused looks a lot more like a revenue raising exercise to me rather than anything to do with traffic management, but I doubt that argument will cut any ice with them.

So when the deadline approaches, would appreciate some general advice/guidance about the grounds that should be mentioned in my reps, if you can spare the time.

Many thanks.

The traffic lights on the left as you approach the junction (after the signage that shows no right turn) have a No Right Turn disc in them too. So there are 4 signs.

2021 GSV shows an advance warning sign and the prescribed NRT sign situated on the traffic light column on the left-hand footway. Your photos apparently support this as being current.

Signage is not at issue IMO.

Hippocrates's suggestion regarding submitting reps is always worth a go as long as you compile your reps and cut and paste into their online portal, in this way you would have a copy. Reps should be made on the last day of the 28-day period which is 22 Oct. (this is not the period of 28 days from service of the PCN but beginning on date of service i.e. 25 Sept.).
