Free Traffic Legal Advice

Hi, I was issued a penalty charge as apparently where doing some roadworks in streatham, was sunday monring at 09:31 and stopped to have a coffee in a parking that normally is 1 hour free Monday to Saturday and free on sundays. When I went to the coffee shop I was told I should move the van, as the parking is suspended, due to this I moved the Vain straight way, I must have stayed no more the 90 seconds to 2 minutes. But Apparently was a camera and they took a photo me and my 3 year old coming down from the van.

Can I challenge this and if yes, in what grounds, Van is company Car.

Hang on a minute !  My copy of the The Civil Enforcement of Road Traffic Contraventions (Approved Devices, Charging Guidelines and General Provisions) (England) Regulations 2022 has thism in Regulation 11:

Circumstances in which notification of a penalty charge for a parking contravention on a road in a civil enforcement area may be given otherwise than by fixing a notice to the vehicle
11.—(1) The circumstances specified for the purposes of regulations 9(4)(b) and 10(3)(b) are circumstances where the relevant vehicle is stationary on—

(a)a bus lane,

(b)a bus stop clearway or bus stand clearway,

(c)a carriageway outside a school entrance which is marked in accordance with diagram 1027.1 at item 10 in Part 4 of Schedule 7 to the Traffic Signs Regulations and indicated by the upright sign at item 10 in Part 3 of Schedule 4 to those Regulations,

(d)a red route, or

(e)a mandatory cycle lane which is additionally marked in accordance with any of the following diagrams referred to in Part 4 of Schedule 7 to the Traffic Signs Regulations—

(i)diagram 1018.1 at item 1;

(ii)diagram 1017 at item 2;

(iii)diagram 1020.1 at item 3;

(iv)diagram 1019 at item 4.

CCTV enforcement of a suspended parking bay is not on that list, so the PCN is void.

Van is company Car.

Before going any further, is the PCN actually addressed to you by name or simply been passed to you to deal with by your company?

Until we know what's what, IMO reps will have to wait I'm afraid.

Also, as this seems to be a local watering hole, pl take your own photos. For example, is the suspension sign still there? If so, we need to see the details. Also, do the signs totally obscure the regular red route traffic signs?

On which point, pl take photos of the preceding bus stop markings and traffic sign. The whole basis for using a camera is that this is on a red route, but I cannot see red route bus stop markings, perhaps it's my ipad.

According to Google Street View this is a Red Route and there are 2 signs.

Any reps would have to be made stating clearly that you are an officer of the company (sole Director if Companies House website is correct) authorised to make representations.

By the way, either your DVLA or Companies House address is incorrect, I suspect the latter which has '1st Nicholas.., not 1 St. Nicholas....).
