Double Yellow Lines

Hi again,

I have received today a Penalty Ticket because I have left the car in double yellow lines while I had to drop off my child at home.

That's where I have left the car parked. I will attach a photo of the ticket as well.



I would like to know if I can win this appeal?

As well as both sides of the unredacted PCN, please post a GSV link to the location.

Also pleaser provide some context to the drop off - e.g. - when did you park? how long were you away from the car? How old is the child? How far is home from where you parked?

Thanks John. 18months old child, around 30 minutes.

I have read the ticket and says that I have received the fine because I have parked on outside hours. Which really confused me as there are no signs at all.

I fully appreciate the importance of parking rules, especially around restricted zones. However, I would ask the council to consider the exceptional nature of this situation, the vulnerability of the child, and the fact that my actions were taken out of concern for their safety — not convenience or disregard for the rules.
This was a one-off event, and I would be grateful if the council could exercise discretion in this instance.

DYLs need no signs.

Not really... you are not pleading for mercy, but claiming a statutory exemption to the ban on parking on DYLs, that of assisted boarding/alighting. But it is up to you to show why the exemption applies.

Sorry about the apparently intrusive questions, but should it reach adjudication, they are the sort of questions an adjudicator might ask ask as he seeks to understand such a lengthy wait.

Cases involving such a wait (and longer) have won at tribunal in the past, but the length of stop must be shown to be necessary.

I was away for 30 minutes.
The child is 18months.
At the time I was the only one who was carrying the child.

Just small update on this: I have read the PCN again , and they made a mistake when they mentioned the colour of the vehicle. They did put Black when on paper is Blue.  Can this be used for appeal ? Thanks

Sorry, no. The PCN must contain a set of statutory information; colour of vehicle is not mandatory.

Barring procedural errors of mega proportions by the authority, IMO get out with minimum cost.

As you didn't leave the baby at home alone, somebody else was there. Your obligation was to move out of contravention as soon as possible. IMO, 30 minutes means you did not.
