Author Topic: Hounslow - Parking in a disabled bay without badge where council had painted out "disabled marking" but left sign up  (Read 298 times)

I hope someone can provide a bit of advice on a PCN for parking in a disabled bay.

The disabled space in question was for a neighbour who died in 2022. I wrote to the council 17 June explaining the disabled space was not needed . On 18 June council responded saying that the space will be added to the revocation list to "progress the black-out markings and to remove the post/sign in due course. This can take time ... Please bear with us whilst this is being arranged."(copied in full below)

At the end of August the council blacked out the marking which labelled to drivers that the space was a disabled space. But left the sign. I had assumed from my email with the council that once they had progressed the black out of the markings that the space was no longer a disabled space. (the disabled space a few doors up still has the markings).

Needless to say it turns out that the space is still a disabled space, and the council are currently consulting on its removal (consultation started on 6 September to end on 27 September).

Do I have ground for an appeal? Or am I better off just paying the reduced fine.

Thank you for your email and bringing to our attention the disabled bay in your road.

We will add the disabled bay on to  the Revocation list to progress to black-out the markings/Text and to remove the post/sign in due course. This can take time as this request is also part of advertising on Traffic Management Order to permanently remove the measure.

Please bear with us whilst this is being arranged.

I'd say you were entitled to believe the bay was revoked when they painted out the legend and a polite challenge will hopefully see this off. The CEO's pics show the legend gone.
