Hi,

Have been advised to post on here for help.
Received this recently (30/6/23) in the post dated 28/6/23 , and curious to know if there is any way shape or form to contest it. Having reviewed the highway code again it looks like its a tough ask, from my perspective its 05.57am (26/4/23) in the morning and I am following the Car infront in an area i do not know (i had just left my Hotel). They have breaked and stopped just before the line at the lights, which without conducting an emergency stop leaves me with no other alternative than to stop in the Grid. I would argue i am not obstructing the ability for vehicles to cross the Junction at all, but i am curious to hear the views from others.

However the dates on the PCN open a possible avenue, is the vehicle hired or leased by any chance?

If so, you need to write to the lease or hire company as follows:


Dear Hire Company,

I am in receipt of PCN XL96093869 and I understand you asked the local authority to transfer liability to me. Having taken legal advice, I would like to know whether you have received any correspondence from the council after you requested liability to be transferred, and if you have I would like to request a copy. I need a copy of this documentation in order to pursue my appeal.

If you have not received any further communication from the local authority, please could you confirm this to me.

If the vehicle isn't hired or leased let us know as that would be really, really easy.

The deadline to make representations and preserve the discount is 11 July 2023 so don't lose track of that, if you've not heard back from the lease company by the end of next week let us know and I'll give you a draft you can send to the council to buy some more time.

The council will likely reject but it's an easy case to argue at the tribunal.
