PCn - Redbridge - Stopped on a restricted bus stop or stand
« on: »
Hey folks,
I just received a PCN through the post for 'Stopped on a restricted bus stop or stand'. Are there any grounds for appeal here?

Thanks.

On the face of it the video shows what looks like a fairly clear contravention. Why did you stop there ? Are you aware there are things like "restricted bus stops" ?  As well as the broad yellow line, there must be a sign too, which normally says "No Stopping except local buses"; is there one ?

This may not be game over, so wait for those expert in these matters to contribute, but don't miss the payment/appeal deadline waiting.

It's my wife's car and I can only suspect it was late at night and she didn't see the signs or notices. She doesn't recall the incident so suspects it could be one of her siblings who was driving at the time.

I'll wait to hear from some of the other experts :o)

Agreeing with Incandescent above, there' also a white BUS STOP sign next to the road. However, there must be a yellow sign facing the roadway that says no stopping except buses. Almost every bus stop in London is now a stop for buses only, 24/7/365 a year.
Go and have a look for the yellow sign, if it's missing there's a good chance of winning at tribunal, I speak from personal experience. In my case the sign was there but the council's evidence pack didn't have a photo of it. But I also had a very good reason to stop where I did.
Bus driving since 1973. My advice, if you have a PSV licence, destroy it when you get to 65 or you'll be forever in demand.

hey all,
I have posted some photos in google drive folder below. There is a small sign next to the bus stop but was not spotted at the time.

I have to say I do not see any "killer" appeal based on what you've shown, and told us so far. The bus stop seems to be correctly signed and marked out.

@Incandescent
Thanks for your frankness. I'll wait a few more days for additional responses, and if there are none by then, I'll settle the fee within the discount period.

Here's an initial draft:

Dear London Borough of Redbridge,

I challenge liability on the basis of a procedural impropriety. The location of the alleged contravention is given as "High Road", the PCN mentions bus stop A which I have not been able to locate but there are no less than 33 bus stops along this road.

I was not driving the car at the time and in the circumstances, the PCN fails to adequately particularise the location of the alleged wrongdoing.

In the circumstances the penalty charge must be cancelled.

Yours faithfully,

Send it online and keep a screenshot of the confirmation page.

In the meantime I'll get the data about the make and model of the camera.
