Hi All,

Found an Easter present in the post through my favourite council.

Essentially, i was stationary within a box junction. But this was due to the fact that there was a very tall van in front of me, and i could not guage traffic in front. When it stopped, i tried to reverse round the corner but saw cyclists there - not possible. Tried going to the side of the big van in front of me, but realised that'll be hazardous for oncoming traffic - not possible.

Here are the images of the PCN:

Video for contravention

Grateful for any advice and guidance on appealing the ticket - if indeed i can appeal at all.

Thanks,
K

Your video is set to private, if you upload it to youtube and post the link on here in the format

it will appear as an embedded player.
I am not on the "motorists's side", nor am I on the "police/CPS/council's" side, I am simply in favour of the rule of law. Section 6 of the Interpretation Act 1978 applies to everything I post as it would apply to an Act of Parliament. I am a Conservative councillor, this means some people think I am "scum". I am not a lawyer.

Here is what im thinking in terms of an appeal, based on suggestions above. Should i also add in my version of events i.e. really difficult to guage whats ahead due a towering van in front of me etc.

---

I am writing to formally appeal the parking ticket (Penalty Charge Notice) referenced above that was issued to my vehicle on [Date]. I believe that the grounds for this appeal are substantial and warrant a review of the decision.

Questionable Vehicle Stopping:
While the PCN alleges that my vehicle stopped within the box junction, it is debatable whether the vehicle came to a complete stop for a significant duration (exceeding 5 seconds). Throughout the footage, there are instances where the wheels are observed to be in motion, and the reversing lights are evident, suggesting momentary pauses rather than a prolonged cessation of movement. The video abruptly ends before my vehicle exits the box, leaving the full context of the situation unaccounted for.

Degraded Box Markings:
An inspection of the box junction markings, as depicted in the evidence provided, reveals significant degradation and wear on substantial parts of the box. The faded and worn-out markings raise concerns regarding their visibility and effectiveness in guiding motorists, potentially contributing to confusion or misinterpretation of traffic regulations.

Ambiguity Regarding Location:
The PCN identifies the location as York Road, yet it fails to specify the other roads forming part of the junction, as required. Based on available evidence, it appears that my vehicle was situated in Mill Road, raising questions about the accuracy of the location stated in the PCN.

In light of the above points, I respectfully request a thorough review of my appeal and urge the adjudicator to consider the circumstances outlined herein. I firmly believe that the evidence presented warrants the cancellation of the parking ticket issued against my vehicle.

Thank you for your attention to this appeal. I anticipate a prompt and fair resolution.

Yours sincerely,
