Grounds Procedural Impropriety.
For info, the Notice of Rejection:
1. Fails to inform you correctly of your rights of appeal;
2. Fails to inform you correctly of the council's power to serve a charge certificate.
1a - because you only have a statutory right to register an appeal up to the end of the period of 28 days BEGINNING on the date of service of the NoR;
1b- because you were not informed that the adjudicator may register an appeal AFTER the end of the 28-day period.
2a- the council may only serve (not send as they have said, but serve) a CC after your STATUTORY appeal period has ended. Therefore it follows that by specifying this with reference to the incorrect date base in 1a they have failed to inform you correctly of their power in this regard.
Each of the above is mandatory and therefore by failing to comply with the regulations they have committed a procedural impropriety in EACH case.
In short, they're incompetent, but sadly this is not grounds of appeal!
You should register your appeal by 10 August - NOR issued Thurs. 10 July, deemed served Mon. 14th which is day 1 of the 28-day period.
But do it beforehand, you don't want to miss deadlines.
