Hello,

Hoping people here might be able to help me approach this dilemma I am assisting my family

The main driver (my sister) went travelling for 6 months and on occasions a name driver on the vehicle used it while she was away. On the 9th May they drove down a road during hours in which traffic was limited and hence received a PCN. There is no plan to contest the PCN, however because the PCN came while she was away it was in her post which she has just opened today, meaning now when attempting to pay the PCN the cost is now £240, although no letters have been sent from the council apart from the original PCN

Any advice on how to approach the council to reduce it to the original amount? Do you think they are likely to be responsive?

Those details don't seem to be correct for a Barnet PCN. Is there a digit missing from the PCN number?

Please post up a scan or photo of each page of the PCN. Just redact the name and address and leave everything else visible.

Who is the Registered Keeper of the car as stated on the car's V5c document? Your sister? In which case she is liable regardless of who was driving.

Sorry, but we do need to see the actual documents, so please post up what your sister has received, Having said that, the sum of £240 indicates that a Charge Certificate has been received as well as the PCN. (PCN =£160, plus 50% uplift for Charge Certificate = £80 giving £240 on the Charge Certificate.
Please also read this and update your thread as necessary. Only redact name and address from documents


As for the PCN, her options to pay or submit representations have not gone with the service of the Charge Certificate, (CC). There are two things she could do, other than pay the CC; (1) she could contact the council to explain what has happened, but this is outside the enforcement process, as there is no appeal option once the CC has been served, but she might be lucky. (2) ignore the CC and wait for the Order for Recovery to arrive. This adds £10 onto the £240, the small addition being the Traffic Enforcement Centre fee for registering the debt. At this stage she can submit a Statutory Declaration that the PCN was not received. OK, it eventually was received, but far outside the period allowed for payment or representations, so in reality was not received.  TEC will then cancel the OfR, the CC, and the matter reverts to the PCN which you can then pay or appeal.

I have updated the post to include a link with the photos of the PCN. We have carefully checked our post and aside from the PCN, no charge certificate arrived at our address in writing

My sister is the named keeper of the car on the V5c form

If she opts for option A and hoping to get lucky, would that complicate matters if they refuse and she chooses to ignore the CC and submit a Statutory Declaration when the OfR arrives?

You need to redact all entries of name and address from the PCN asap.

So where have you got the sum of £240 from if you have not received the Charge Certificate ?  You should have received this, if the sum is shown on their website.

Phoning Barnet doesn't affect any submission of a Statutory Declaration. Main thing is not to dive in all confrontational, but just explain circumstances, and ask that the matter be reverted to the PCN.

The charge certificate arrived in the post today, although before was just seeing it on the website. Phoned Barnet council who advised to send them an email instead but said they put a note next to the case to expect an email. Lets see what they say
