PCN Islington
« on: »
Hello
I got a PNC through the post today and wanted to get some advice as I think it's abit unfair

I went through Islington on the way home from a gig (I live in Norfolk) so don't know the roads round there at all!
I went through an area with a max width restriction. First one I went through but was very very close and didn't want to clip my wheels ect. The 2nd one I come to there was a massive gap in the middle so decided instead of risking my car I'd go through there and knowing it would fit so the vehicle is allowed in the area. This was at 11pm at night with no one around but was caught on camera.
I understand why its there but just seems abit unfair and alot of money.

Thanks
   Fraser

Well, here's a GSV view with a car coming through the gap: -

I think the contravention is made out, but Hippocrates may suggest a 'technical' appeal based on their mismanagement of the enforcement process. These have nothing to do with the actual contravention, and have won quite a number of appeals now, at London Tribunals, but you must forego the discount option, because these end up at London Tribunals.

The contravention is not obeying a mandatory keep left sign and these are almost impossible to challenge unless there was a complete obstruction, police direction or such like.

I do recall there was some success at this location on the road markings but that was a few years ago.
