PCN in box junction, Ilford Lane, Redbridge
« on: September 04, 2024, 08:19:08 pm »
  • PCN from London Borough of Redbridge
  • Entering or stopping in a box junction when prohibited (camera enforcement)

Hi guys,

is there any chance of appeal on this?

  • The contravention was on 30/06/2024, the later is dated 02/09/2024
  • On the website, there is only 2 images as below, no cctv footage. The image does not prove how long, if any duration, I was actually stopped on the box junction, nor does it demonstrate the circumstances as to what may have resulted me being there.
  • The actual image of the vehicle doesn't show the vehicle registration
  • The image that does show the registration, doesn't show any offence whatsoever, i.e. everything around it is black and nothing to show that registration is actually committing any offence, could be a totally different vehicle all together. Doesn't prove its part of this same offence

This is a long term rental vehicle, so it may have gone to the company who would have denounced responsibility, hence why it may have taken extra time to come to me with a delayed issue date. I haven't had any communication from them so not sure if it could have directly come to me anyway, even if not, is there grounds of appeal based on the contravention date and current issue date and the points raised above, or anything else for that matter?

Thanks

I uploaded photos but it said it was full, I put the images with the code but the photos were not showing so have just put the links below.

As yellow box contraventions go this is pretty solid and shows you why we have yellow boxes... You did keep moving but had to stop.

There may be something in the processing and reissuing of the PCN.

Think we've see this Ilford Lane box a few times - possible vague location.

Oh you found the footage lol, I didn't find it! Even so, it doesn't actually show the registration on the footage due to the lighting...?

The camera has a setting that takes a still image showing the plate so that won't wash.

1. Please follow my advice in this post.

2. Redbridge have a habit of sending off Charge Certificates so I would recommend making your formal representations close to but before the deadline. I have represented two members recently and they did the same, one of which was immediately won on that abuse of the statutory process.

3. Show us the agreement as there may be flaws.

There are known knowns which, had we known, we would never have wished to know. It is known that this also applies to the known unknowns. However, when one attends a hearing, Mr Rumsfeld's idea that there are also unknown unknowns fails to apply because, anyone who is in the know, knows that unknown unknowns are purely a deception otherwise known as an aleatory experience or also known as a lottery. I know that I know this to be a fact and, in this knowledge, I know that I am fully prepared to present my case but, paradoxically, in full knowledge that the unknown unknowns may well apply in view of some adjudicators' lack of knowing what they ought to know through no fault of their own.

What is a charge certificate? Would it come after the 50% discount period? What is the actual abuse of statutory process which I could potentially appeal on?
