Author Topic: PCN Hillingdon, 12 parked in residents parking place without permit  (Read 247 times)

Hi all,

I have been living at my address in Hillingdon, London for 10+ years. In early March I got a PCN for parking without a permit on my road - this came as a surprise to me as I am a resident and pay the annual fee. Upon investigation, I realised that my permit had expired at the end of January and mentally missed this. In previous years, I'd get reminder emails weeks in advance of the expiry date and this is what allowed me to ever avoid similar PCNs in the last 10 years of living at my address.

I challenged the PCN on the grounds that I had not received a reminder email and my challenge was rejected as they claimed reminder emails were indeed sent. I then challenged it again on the same grounds but this time asking for proof such reminder emails were sent to me. This has again been rejected (without such a proof being sent to me).

(I don't have the other earlier appeal rejection/communication to hand as I am currently abroad. Also, I haven't specified the exact address as it is the one I am resident in but the parking hours of operation are 9am-10pm 7 days a week - strict due to proximity to Heathrow)

Do I have any grounds to appeal further or should I just pay the reduced fee (I still have a chance to do so)? I should have probably posted on here before appealing but this didn't come to mind as I have only previously used this forum for help with private parking tickets.

Post the VRM and PCN number if you want it looked at for other angles.

But it looks like you got a lot of grace for an expired permit and lack of reminder emails are not usually grounds for an appeal but there could be grounds for a recommendation as below.

Reasons   The Appellant has attended her appeal by video link, the Authority was not represented.
The Authority's case is that the Appellant's vehicle was parked in a residents' or shared use parking place or zone without a valid virtual permit or clearly displaying a valid physical permit or voucher or pay and display ticket issued for that place where required, or without payment of the parking charge when in Manor Road on 13 November 2024 at 10:30.
The Appellant's case is that she did not receive any email reminders and as soon as she realised that her virtual permit had expired she renewed it.
I have considered the evidence in this case and I find that the Appellant's vehicle was parked in a residents' or shared use parking place or zone without a valid virtual permit or clearly displaying a valid physical permit or voucher or pay and display ticket issued for that place where required, or without payment of the parking charge when in Manor Road on 13 November 2024.
I find that no exemptions or defences apply to this PCN.
All matters raised by the Appellant go to mitigating circumstances, they do not provide an exemption or a defence.
The Adjudicator decides appeals by making findings of fact and applying the law as it stands. The Adjudicator has no power to quash a penalty charge on the basis of mitigation submitted.
That said I recommend that the Authority cancels this PCN for the following reasons:
First, I accept the Appellant's evidence that she did not receive the reminder emails.
Second, the Appellant is a pensioner and has worked hard all her life, I find her to be honest and genuine in presenting her case.
Third, the Appellant's permit had expired some 10 days before this PCN was issued, and there is no doubt in my mind that if she had realised that her permit had expired, she would either have parked in her driveway or renewed her permit. In fact she renewed it as soon as she was aware it had expired.
Fourth, these permits are virtual and it is much easier to miss a renewal date than if it had been a paper permit.
Fifth, account should be taken of this Appellant's age - she is elderly and as one ages it is easier to forget.
In all the circumstances in this case I recommend that the Authority cancels this PCN.
The appeal is refused with the above recommendation.
Recommendation   cancel the Penalty Charge Notice.

Obviously if you take the matter to London Tribunals, it would be with the full PCN penalty in play.
