hello all i got a pcn from haringey for a right turn at a yellow box junction (attached the original pcn). i made a representation to the council after some advice here. My response was as follows:
“Hello please find the reasons below why I don’t believe this pcn applies -The right turn exemption (as drafted) should apply It states: The prohibition in sub-paragraph (1) [i.e. stopping when prohibited] does not, in respect of a box junction within sub-paragraph (6)(a) of the definition of that expression [i.e. a box junction situated at the junction of two or more roads], apply to a person who— (a)causes a vehicle to enter the box junction for the purpose of turning right; and (b)stops the vehicle within the box junction for so long as the vehicle is prevented from completing the right turn by an oncoming vehicle or other vehicle which is stationary whilst waiting to complete a right turn. I satisfy both points. - Further PCN 2170442131 issued in Hammersmith & Fulham (Talgarth Road at the junction with Butterwick at 6.33pm on 8 May 2017) also went to a adjudicator for the same alleged contravention as my PCN and the adjudicator agreed with the motorist and upheld in the motorists favour their appeal to the adjudicator.”
Haringey council have replied with the attached letter rejecting it.
Any thoughts? Do i stand a realistic chance taking it further or should I pay it? Any help would be appreciated thank you
