Hi,

I have been given several PCNs from where I work.

This is due to an error in my new car not being put on the land-owners system. As I have trusted the process I have not picked up these PCN's till late as I have been living and looking after my parents who have had a few issues.

As soon as I found out I had a charge, I spoke to their legal team who advised me to talk to TPS. I emailed them on their advice explaining that I work there and I should not have to pay as I was out of the appeals time, but noted that I worked there. At no point did they advise me of additional PCN's nor did they advise me on how I can appeal their decision by going to their regulatory body. Therefore I paid them as I was not is the best of mental states due to me having a back procedure due to pain and I was on high levels of analgesia with a trip to A&E due to this.  Nor did they ever advise me to speak to the land owner to ensure that my vehicle reg was on the system. 


I thought this was the end of the matter.

This was not to be the case. I later found out that if I had spoken to the Landowners they would have asked for the PCN's to be removed, and I should have not paid the fine. I only found this in April when I had a hire car.

Since then I had a CCJ claim. I then went to the Landowners with all this and they have asked for the claims to be removed. However, this was not done by the lady who deals with it normally, as she was on holiday. So I have challenged the claim and have sent in an a acknowledgement to give me additional time to prepare evidence for my appeal.

I am also yet to decide if I should counterclaim against the parking company TPS.

I also asked the gentleman who sorted the claims out to send me an email to say that he had asked for the PCN's to be removed and for TPS to inform me when this has been completed.  They have not done this instead I had to ring them to ask if this had been done. The last 2 had been cancelled some 54 days after the 28 days I needed to pay the fine. The rest was with their legal team who were looking into it so they could not comment on it. TPS also refused to email the PCN numbers over rather I had to take them by hand.

Then today I was given a CCJ notice dated the 17th April - to which I did not have the claim form - after seeking legal advice I need to complete an N244 form and ask for it to be set aside.

This sounds like a private ticket issue; who are TPS?

Your description around the claim and CCJ is very vague. Please give a detailed account.  In particular, is this a single claim? Have you received a judgement in default, and if so what was its date of issue? Did you fail to submit a defence in time?
