Hi all,

So I am absolutely shocked that my car has been towed. So my car was parked outside number 23 (odd numbers) and the restrictions was only monday and tuesday on my side. This was then removed by Wednesday morning and therefore no signs were on my side. The opposite side which refers to 54-18 was wed-fri. The picture of the restriction only states cars parked between 54-18 which was placed opposite to where i was parked and therefore does not apply to me.The other sign was placed outside number 13 which stated opposite 54-18 but they have placed this in error as how can you put a restriction on a place where it does not apply. There was no restriction signs on my side hence why there is no picture of my car next to one or any other signs which has odd numbers or states 'opposite' except the one placed outside number 13.

OK, so the good news, (if there is any !!), is that you have already paid all there is to pay, so by appealing the matter all the way, you could get all of that money back. You'll need to submit reps to Newham, and then. when rejected, register an appeal at London Tribunals, where your council reps will form your reps to London Tribunals. Your reps need to emphasise that the sign on Wednesday applied to the opposite side of the road, there was sign on your side when you parked that day.

Have you registered an appeal at London Tribunals yet ? You have nothing to lose at all by doing so, because you have already paid all there is to pay and there are no additional costs. The only thing I cna't get my head round is this - where was the suspension sign in relation to where your car was parked ? If you could, please post a view of Penge St like this: -

Reasons   The allegation in this case is that the vehicle was parked in a restricted street during prescribed hours on 15.04.25. The Enforcement Authority rely on signage of temporary restrictions. They have provided photographs of a number of large, bright yellow signs in place on 08.04.25. They have also provided photographs taken by the Civil Enforcement Officer which show such a sign but not in context with the vehicle. It may be that the Appellant has been fortunate on this occasion but I do not feel able to say I am satisfied that at the time of issue of the PCN the signage of restrictions was substantially compliant, clear and adequate. Accordingly I allow the appeal.

Reasons   The allegation in this case is that the vehicle was parked in a restricted street during prescribed hours. The Appellant criticises the quality of the signage. She says that signage was only installed afterwards. She also says that she did not receive the PCN.
The Enforcement Authority rely on temporary restrictions. They have provided an example of a large, bright yellow sign to this effect. However they have also provided photographs taken by the Civil Enforcement Officer and the only sign shown is an inconspicuous A4-sized sign with small-font black print on a white background. It may be the Appellant has been fortunate on this occasion but on the evidence provided I am not satisfied the signage of restrictions was substantially compliant, clear and adequate to draw the motorist’s attention to temporary restrictions. Accordingly I allow the appeal.
