Charge Certificate Newham

Hello

I've received a Charge Certificate today for a PCN issued in April, originally I did not see a PCN on the car, either removed or fallen off.

The council sent a NTO and I responded with the fact I did not receive the PCN and to offer the discount again, for two months no letter or email was sent.

I don't mind paying the original fine, but it's gone to £120 without being offered any representations or rejection, either an issue with post or wrong email, I have no way to check where they sent the replies or if they were even issued, any help would be appreciated please

That is a Charge Certificate, not a PCN. If you submitted reps and got no reply, you now need to wait for the last statutory document called an Order for Recovery.  This is sent when the council register the PCN debt at the Traffic Enforcement Centre (TEC). At this stage you can submit to TEC a Witness Statement telling them you submitted reps but received no reply.  The OfR and CC will be cancelled and the matter reverts to the PCN stage.

Blue badge holders are not subject to the time limit and the photos show a blue badge on display, but it looks like it expired:







Have you since obtained a new one?

Read from the charge certificate paragraph down to the bottom of the page.

You cannot rely on the post, therefore you need to keep an eye on the amount due on the council website. When the OfR is issued the penalty will go up to £129, at that point even if you haven't received anything in the post you can download form TE9, fill it in on your computer (don't do this yourself, ask us for help and we'll explain how) and email it to tec@justice.gov.uk
